As used in this chapter, the following terms shall have the meanings indicated:
NUISANCE
A. 
Accumulations of garbage and rubbish, such as but not limited to newspapers, cans and glass.
B. 
Abandoned or junked automobiles, trucks, appliances, furniture.
C. 
Accumulations of material deemed as a safety hazard.
D. 
Dangerous structures.

It shall be the responsibility of the property owner, or persons in control of such property, to remove and abate all nuisances.
Clarion Borough shall have the power, authority and right to prohibit and remove any nuisance as defined in § 134-1 of this chapter.
Any person, firm or corporation who or which shall violate or fail, neglect or refuse to comply with any provision of this chapter shall, upon conviction thereof:
A. 
Be sentenced to pay a fine of not more than $1,000 or less than $250 and costs of prosecution and, in default of payment of fine and costs, to imprisonment for not more than 30 days; or

B. 
Clarion Borough may remove any nuisance, as defined in § 134-1 of this chapter, and collect the cost thereof, together with a penalty of 10% of such cost, in the manner provided by the law for collection of municipal claims or by action of assumpsit or may seek relief by a bill in equity; or
C. 
Be subject to both Subsections A and B of this section.
