The following words and phrases, when used in this chapter, shall have the meanings given to them in this section:
PEDALCYCLE
A vehicle propelled solely by human-powered pedals. The term does not include a three-wheeled human-powered pedal-driven vehicle with a main driving wheel 20 inches or less in diameter and primarily designed for children six years of age or less.
PUBLIC PROPERTY
Any street, trafficway, alley, sidewalk, parking lot, park or recreational area owned by the Borough of Clarion, or any public highway, sidewalk, parking lot or trafficway located within Clarion Borough.
A. 
The owner of a pedalcycle which is ridden or operated in the Borough of Clarion and the owner of a pedalcycle residing within the Borough of Clarion is encouraged to register said pedalcycle with the Police Department of the Borough of Clarion at the police station, and shall make application for such registration to the Chief of Police on a form provided for that purpose. If the owner is a minor under the age of 16 years, then the minor's parents, or one of them, or, if said minor does not reside with his parents or either of them, then the adult person having care of minor or the adult person with whom the minor resides, may make such listing and registration and the application thereof on behalf of said minor owner.
B. 
Pedalcycle registrations shall be serially numbered and kept on file by the Chief of Police at the police station as a public record. The Chief of Police shall determine the information to be recorded on the registration, which may include the serial number, make, model, color and style of the pedalcycle and shall include the owner's name, address and telephone number.
C. 
The Chief of Police or his designee, upon receiving proper registration of a pedalcycle, shall affix or cause to be affixed to the pedalcycle frame in a prominent location an identification tag, plate or sticker serially numbered to correspond to the pedalcycle registration. A registration card shall be issued to the owner of each properly registered pedalcycle.
D. 
A registration fee will not be charged.
E. 
It shall be the duty of the owner to ensure that any registration tag, plate or sticker issued to his or her pedalcycle is properly attached and remains attached until transfer of ownership, at which time the tag, plate or sticker shall be removed by the owner.
F. 
It shall be unlawful for any person other than the owner to remove, deface or otherwise obstruct from view any registration tag, plate or sticker, except that the owner shall remove it as noted in Subsection E.
G. 
The registration and tag, plate or sticker shall not expire unless the ownership of the pedalcycle to which it has been affixed is transferred to another person, whereupon the registration shall immediately expire.
H. 
It is recommended of any purchaser or transferee of any registered pedalcycle to make application for a new registration of such pedalcycle within five days of receipt.
I. 
It shall be unlawful for any person to intentionally remove, deface, alter, mutilate, obstruct or conceal any pedalcycle registration tag or pedalcycle frame or serial number. It shall be unlawful for any person to fraudulently alter a bicycle registration card or refuse to display such card to a police officer.
A. 
Every person riding a pedalcycle upon public property shall be granted all of the rights and shall be subject to all of the duties applicable to a driver of a motor vehicle. Every pedalcycle rider shall obey all of the traffic ordinances of the Borough of Clarion and the traffic laws of the Commonwealth of Pennsylvania.
B. 
It shall be unlawful for any pedalcycle rider to indulge in abnormal, reckless or trick riding, or to hitch onto another vehicle upon public property.
C. 
It shall be unlawful for any pedalcycle rider to willfully fail or refuse to obey the directions or signals of a police officer or to fail or refuse to bring his pedalcycle to a stop or to otherwise flee or attempt to elude a police officer when given visual, vocal or audible directions to bring his pedalcycle to a stop.
D. 
An operator of a pedalcycle shall yield the right-of-way to any pedestrian lawfully crossing a roadway or upon a public sidewalk, trafficway or parking lot.
E. 
It shall be unlawful for any operator of a pedalcycle to chain or otherwise attach said pedalcycle to any lamppost situated upon public property. It shall be unlawful to park a pedalcycle against any automobile, structure or building without consent of the property owner or to park so as to obstruct any pedestrian, motorist or pedalcyclist lawfully using public property.
F. 
Where a special event, authorized by the Borough of Clarion, is underway, a police officer may order any operator of a pedalcycle to dismount within the area of the special event, and to cease operation of a pedalcycle within the area. It shall be unlawful for a pedalcyclist to refuse to dismount or to disregard the lawful instructions.

Any person, firm or corporation violating § 151-2F or I or § 151-3B, C, D, E or F of this chapter shall, upon conviction thereof by a Magisterial District Judge, be guilty of a summary violation and be subject to a fine of not less than $30 nor more than $600 together with costs of prosecution or, in default thereof, to incarceration of not more than 30 days.
