GENERAL REFERENCES
Recreational vehicles and motorcycles — See Ch. 107.
This chapter shall be cited as the "East Bradford Township Vehicle and Traffic Ordinance."
Words and phrases, when used in this chapter, shall have the meanings ascribed to them in the Vehicle Code of the Commonwealth of Pennsylvania (75 Pa.C.S.A. § 101 et seq.) (hereinafter "Vehicle Code"), as now in force, or as hereinafter amended, enacted or reenacted, except where the context clearly indicates a different meaning.
The police officers of East Bradford Township are hereby given authority to direct traffic on the highways of the Township and at intersections thereof.

A. 
It shall be unlawful to park, or allow to be parked, any motor vehicles or other vehicle, on any street or road which is part of the Township road system, after the start of any snowfall and until the snow has stopped falling and has been completely plowed for the full width of the cartway.
B. 
Any member of the Police Department, or employee of the Township, is hereby authorized to have removed any vehicle parked upon any Township street, highway or roadway, which is in violation of the terms and provisions of this section, and to remove, or have removed, any said vehicles to the local garage or other place of safety. The registered owner of any such vehicle shall be promptly notified in writing of the removal, the place where the vehicle has been removed, and where s/he may obtain same upon payment of any and all towing and storage charges.
C. 
It shall be unlawful for owners, occupants or tenants of any property to dump, throw, shovel, pile or push any snow or ice removed from driveways or walkways into any highway, public street or roadway, which is part of the Township system, park or public property in the Township. No snow, ice, slush, or a combination thereof, shall be pushed or deposited into any drainage area, stream, river, culvert or catch basin. Upon direction or notice from the Police Department or employee of the Township, any person who is found pushing, dumping or depositing snow or ice removed from driveways or walkways onto any highway, public street or roadway, which is part of the Township's system, park or public property in the Township shall immediately desist from such action and shall remove any snow or ice from the Township's system, park or public property that has been unlawfully deposited thereon. If the person so notified fails to comply as aforesaid, he shall be subject to the ticketing and fines set forth in § 104-8F.
D. 
No person shall damage any Township property, including, but not limited to, traffic signs, culverts, curbing, etc. while removing show, ice, slush, or a combination thereof. Any damage to Township property shall be repaired or replaced in accordance with the requirements of the Township at the expense of the property owner and/or snow removal agency. Any person failing to pay for such damage will be in violation of this chapter and subject to ticketing and fines as set forth in § 104-8F.
E. 
Fire hydrants shall not be covered at any time. The property owner is hereby required to remove or cause to be removed all snow, ice, slush or any combination thereof or any accumulation and/or impediment which would limit access to, from, and/or around all of the fire hydrants which are located on the property, so as to provide immediate access by fire rescue personnel in cases of emergency. In cases involving a snowstorm, fire hydrants shall be cleared of all snow, ice, slush, or any combination thereof within 24 hours following the storm, or not less then once in every twenty-four-hour-period during a storm event. Any person failing to properly clear a fire hydrant shall be in violation of this chapter and subject to ticketing and fines as set forth in § 104-8F.
F. 
Any person, firm or corporation violating any of the provisions of this section shall, for each and every such violation taking place within East Bradford Township be ordered to pay a fine as stated on the ticket, payable to East Bradford Township or its designated collector, within 14 days of issuance of such notice. Failure to respond to the notice of violation by payment of the fine, as aforesaid, within 14 days of issuance of such notice, shall result in the issuance of a citation to the defendant. Any person who willfully violates or willfully permits the violation of any of the provisions of this section shall be subject to a fine in the amount of at least $50, but not to exceed $600, plus all court costs, including reasonable attorney fees incurred by the Township. Upon a finding of liability for committing said violation or permitting said violation, in a civil enforcement proceeding commenced by the Township, the defendant shall pay the fine, plus all court costs, including attorney fees. No judgment shall be imposed until the date of determination of a violation by a District Justice, and such fines, costs and attorney fees shall be collectible before any District Justice as like fines, costs and attorney fees are now by law collectible. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure.

B. 
Weight limitation signs shall be posted at the nearest intersections to each bridge listed in the above subsection and at either end of each bridge. The specifications for the signs shall be in accordance with state laws and regulations.
C. 
An evaluation shall be conducted under state law and regulation to determine whether or not the criteria for alternate routes is met, and, if so, alternate routes shall be evaluated and established.
D. 
Any person who violates any provision of this section shall be prosecuted under Section 4902(a) and 4902(g)(1)[3] of the Vehicle Code and, upon conviction, be sentenced to pay a fine of $150 plus $150 for each 500 pounds or part thereof in excess of 3,000 pounds over the maximum allowable weight and costs.

The Superintendent of Public Works of East Bradford Township, with reference to roads under Township jurisdiction, is hereby authorized to erect appropriate signs to designate speed limits, parking restrictions and stop signs. The placement of the signs regulating motor vehicles and traffic under this chapter shall be in accordance with and subject to the provisions of the Vehicle Code, as amended.
Any person, firm or corporation violating any of the provisions of this chapter shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not more than the maximum fine permitted by the Vehicle Code for that violation and costs of prosecutions or shall be imprisoned in the county jail for not more than the period permitted by the Vehicle Code for that violation, or both.

A. 
Any person, firm or corporation violating any of the provisions regulating parking or any of the regulatory parking signs (including appropriate markings on the pavement) shall, for each and every such violation of said parking regulation (or parking control sign or marking) taking place within East Bradford Township and upon ticketing of each vehicle in violation owned or operated by said person, firm or corporation, be ordered to pay a fine as stated on the parking ticket, payable to East Bradford Township or its designated collector, within 14 days of issuance of such notice for each of the following parking violations:
(1) 
Parked in a posted no-parking zone.
(2) 
Parked in a posted temporary no-parking zone.
(3) 
Parked within 15 feet of a fire hydrant.
(4) 
Parked within 30 feet of a stop sign.
(5) 
Double-parked.
(6) 
Parked in a handicapped space.
(7) 
Parked in a fire zone.
(8) 
Parked on private property.
(9) 
Parked against traffic flow.
(10) 
Parked within 20 feet of a crosswalk.
(11) 
Parked on a sidewalk.
(12) 
Parked in front of a private or public drive.
(13) 
Parked within an intersection.
B. 
The East Bradford Township Board of Supervisors shall set the parking ticket fines by resolution.
C. 
Failure to respond to the notice of violation by payment of the fine, as aforesaid, within 14 days of issuance of such notice, shall result in the issuance of a citation to the defendant. Thereafter, the prosecution shall proceed in accordance with the Pennsylvania Rules of Criminal Procedure; and upon conviction of the offense, the defendant shall be ordered to pay the fine, together with the costs of prosecution, and/or to be incarcerated in the county prison for not more than five days.
D. 
It shall be the duty of the enforcement officers of East Bradford Township to report all violations of any provision of this chapter, indicating in each case the section thereof violated, the license number of the vehicle involved in such violation, the location where the violation took place, the time of such violation and any other facts necessary to secure a clear understanding of the circumstances attending such violation. Each officer shall also place on the vehicle a notice of violation to the owner or operator thereof that the vehicle has been parked in violation of the provisions of this chapter, instructing the owner or operator to pay the fine and costs as provided herein and further notifying the owner or operator that failure to respond will result in the issuance of a citation.

A. 
Towing contract. The East Bradford Township Board of Supervisors shall enter into agreements with persons and/or entities ("towing contractor") to engage in the business of removing vehicles of all types that are disabled, abandoned, illegally parked, or snowbound and provide safe storage for such vehicles until their disposition. The towing contract only shall apply when the Township and/or police officers call a towing contractor for the removal of vehicles.
B. 
Towing fee schedule. The East Bradford Township Board of Supervisors shall adopt a fee schedule, by resolution, for the removal of vehicles of all types that are disabled, abandoned, illegally parked or snowbound and for providing safe storage for such vehicles until their disposition, by resolution ("towing fee schedule"). The towing fee schedule may be amended by the Township by resolution from time to time at its discretion. The towing fee schedule only shall apply when the Township and/or police officers call a towing contractor for the removal of vehicles. The towing fee schedule shall not apply to vehicles involved in accidents within the Township; standard towing contractor fees and charges shall apply.

The towing contractor shall comply with the following specifications:
A. 
The towing contractor shall provide properly licensed and operating equipment capable of handling any and all types of vehicles which require towing services. A list of towing vehicles, including descriptions of the make, model, towing capacity and license numbers, shall be submitted to the Township and Police Department.
B. 
Vehicles must be able to be moved by the towing contractor regardless of their disablement.
C. 
The towing vehicles shall be maintained in good operating condition or a suitable replacement made so that the listed vehicles will be available for the purposes of and the duration of the towing contract.
D. 
In addition to the removal of vehicles, the towing contractor shall clean up at the scene of any accident, removing broken glass, metal and other debris as required by the Police Department in charge of the accident scene. Hazardous materials removal shall be treated on a case-by-case basis depending on the type of material to be removed, as determined by emergency responders. Outside contractors may be called to remove such items.
E. 
The towing contractor shall provide services as needed, on a seven-days-a-week, twenty-four-hours-a-day basis. One telephone number shall be supplied to the Township and Police Department for use in requesting service, which telephone shall be available at all times.
F. 
The towing contractor shall dispatch towing vehicles in a timely fashion to insure that such vehicle is on the scene within 15 minutes of the call for assistance from the Police Department. Failure to respond in the aforementioned time period may result in the calling of an alternate tower.
G. 
The towing contractor shall own or lease a storage area within the boundaries of the Township, in a properly zoned area, sufficient in size for the storage of at least 20 vehicles. The area shall be secured with a locked gate and surrounded by a fence that is at least six feet in height. If the towing contractor has not complied with this specification within 30 days after the date of a towing contract, then the appointment of the towing contractor and the towing contract shall become null and void and terminated upon written notice by the Township. This area shall comply with all related municipal ordinances for storage of vehicles, and shall be open for inspection by Township officials and for pickup of vehicles by authorized persons. Authorized person(s) seeking to recover a towed vehicle shall have proper identification and shall be permitted to remove their vehicles upon the payment of the proper charges in accordance with the towing fee schedule, during normal business hours of the towing contractor. The daily storage fee shall be assessed on a twenty-four-hour basis that commences at the time of the tow.
H. 
If a vehicle owner or lessee or other authorized representative of the owner or lessee requests the vehicle to be towed to a location other than the towing contractor's facility, the towing contractor shall advise the customer, in advance, of any charges in addition to the towing fee schedule.
I. 
If the towing contractor is called upon by the Police Department to perform any service(s) other than those specified in the towing contract, including but not limited to towing vehicles involved in an accident, the towing contractor's standard fees shall apply.
J. 
As required by § 7301 of the Vehicle Code,[1] as may be amended, the towing contractor shall comply with the requirements of that chapter, possess a salvor's certificate of authorization and be capable of performing the duties of a salvor in a manner consistent with the public interest. The towing contractor shall file a copy of its/their salvor's license with the Township and Police Department.

K. 
All complaints against the towing contractor will be investigated, recorded, and handled in accordance with the towing contract.
L. 
The towing contractor shall maintain a clean business record that would withstand a police background investigation.
M. 
The towing contractor, its shareholders, officers and directors shall not have been convicted of fraud, theft, receipt of stolen property and/or other dishonest business practices.
N. 
The towing contractor shall keep a record of all vehicles towed and stored under the towing contract and shall be able to, at all reasonable times, furnish to the Township, the vehicle owner, or the vehicle owner's agent the information as to the place of storage of the vehicle.
O. 
The towing contractor shall comply with the specifications of the towing contract, all other terms of this chapter and federal and state law.

The provision of towing services within the Township shall not be on an exclusive basis. The Township reserves the right to execute towing contracts with multiple towing contractors. The Township and Police Department shall develop a rotating schedule of towing contractors, which shall be provided to each towing contractor. The Township and Police Department reserve the right to call any towing contactor, if, in their sole discretion, the towing contractor is better suited to perform the necessary services required. Owners and lessee of vehicles involved in accidents and/or that are disabled are not required to use towing contractors under contract by the Township.

A. 
The towing contractor shall be responsible for the care and protection of all vehicles and their contents when towing or storing vehicles for the Township, and shall be required to procure and maintain proper insurance coverage acceptable to the Township in accordance with the terms of the towing contract and federal and state laws.
B. 
The Township shall be named as an additional insured on all insurance policies. Thirty days' notice of cancellation of any such policies shall be provided to the Township.
C. 
A subcontractor retained by the towing contractor to provide services shall be required to maintain the insurance coverage required of the towing contractor and shall provide evidence of insurance acceptable to the Township prior to commencing work.
D. 
If the towing contractor receives notice of cancellation or nonrenewal of any or all of the coverage required under the towing contract, the contractor shall notify the Township of cancellation or nonrenewal immediately. The towing contractor shall cease all work until coverage acceptable to the Township is obtained.

The Township shall have the power to determine, in its sole discretion, whether there has been a default or violation by the towing contractor. The Township may terminate the towing contract at any time in accordance with its terms.

The towing contractor shall not hire a subcontractor to assist in the performance of the towing contractor's obligations under the Township contract without the prior written consent of the Township. The towing contractor shall alone be liable for payment to the subcontractor for services rendered.

The towing contractor's charges for services rendered by the towing contractor shall be submitted directly to the owner or lessee of the vehicle involved, in consideration for work performed by the towing contractor. The Township shall not be responsible for or pay any of the charges, costs or consideration. The prices for non-accident (disabled, snowbound, illegally parked) towing services shall be pursuant to the towing fee schedule set by resolution by the Board of Supervisors. Payment of towing and storage fees shall not relieve the owner or operator from liability for any fine and/or penalty for the violation of any law or ordinance on account of which the vehicle was removed.

The payment of any towing and impounding charges authorized by this chapter shall, unless such payment shall have been made "under protest," be final and conclusive, and shall constitute a waiver of any right to recover the money so paid.

In the event that any towing and impounding charges so imposed shall be paid "under protest," the offender shall be entitled to a hearing before a magistrate or court of record having jurisdiction, in which case such defendant shall be proceeded against and shall receive such notice as is provided by the Vehicle Code in other cases of summary offenses and shall have the same rights as to appeal and waiver of hearing.
