The Board of Supervisors of the Township of East Caln shall have the
authority to adopt and from time to time amend, by resolution, rules for the
use and enjoyment of Township owned parks and playgrounds, including the conduct
of persons therein. Such rules shall be posted at conspicuous places in parks
and playgrounds.
Any person, firm or corporation who shall violate any provision of this
article, upon conviction thereof in an action brought before a Magisterial
District Judge in the manner provided
for the enforcement of summary offenses under the Pennsylvania Rules of Criminal
Procedure, shall be sentenced to pay a fine of not less than $100 nor more
than $1,000 plus costs and, in default of payment of said fine and costs,
to a term of imprisonment not to exceed 90 days. Each day that a violation
of this article continues or each section of this article which shall be found
to have been violated shall constitute a separate offense. In addition to
the penalty provisions hereof, any fine imposed may be collected by suit brought
in the name of the Township against said violator as by law provided. All
fines for violations shall be paid over to the Township Treasurer.
In addition to the criminal penalty provided in § 130-2 above, the Township of East Caln shall retain the right to institute civil proceedings to recover for any damages to Township park and playground facilities caused by person(s).
