A.
All parties affected hereby shall comply with all
the terms and conditions of this article. The requirements of the
Borough of Adamstown relating to wastewater as now in effect and any
amendments thereto immediately upon becoming effective as to the Borough
of Adamstown citizens, including, but not limited to, the following,
shall be in effect in East Cocalico Township:[1]
(1)
Sewers and Sewage Disposal, Part I, Connection Required
to Public Sewers, Section 105, Prohibited Discharges, and Section
107, Penalty for Violation of Section 105, as attached hereto and
made a part hereof;
(2)
Sewers and Sewage Disposal, Part II, Public Sewer
Rents and Charges, Section 201, Definitions, and Section 205, Reservations,
as attached hereto and made a part hereof;
(3)
Sewers and Sewage Disposal, Part III, Industrial Waste
Discharge, as attached hereto and made a part hereof;
(4)
The Enforcement Response Plan of February 1, 1994,
as amended by Resolution 8012000 of the Borough of Adamstown on August
1, 2000, as attached hereto and made a part hereof;
(5)
All matters required by the Sewer Service and Partnership
Agreement dated September 25, 1995, including, but not limited to,
standards of sewage and enforcement, as attached hereto and made a
part hereof;
(6)
Any and all other controls appropriately applicable
to sewage disposed at the Adamstown Plant;
(7)
Any and all Adamstown policies which shall supersede
those of this Township to the extent that they require more and provide
greater regulation than those imposed by this Township;
(8)
A copy of Ordinance No. 295 of the Borough of Adamstown,
as attached hereto and made a part hereof.

B.
Wherever these documents refer to the Borough as the
enforcing authority, authority for enforcement shall include East
Cocalico Township and East Cocalico Township Authority, which collectively
with the Borough of Adamstown have enforcement authority for those
users of the Borough's POTW located within East Cocalico Township.
The remedies provided for in this article are
not exclusive. Enforcement may consist of any, all, or any combination
of these actions against a noncompliant user. Enforcement of pretreatment
violations will generally be in accordance with the Borough of Adamstown's
Enforcement Response Plan. However, East Cocalico, as the enforcing
authority, may take other action against any user when the circumstances
warrant. Further, East Cocalico, as the enforcing authority, is empowered
to take more than one enforcement action against any noncompliant
user.
All users and owners shall remain responsible
to East Cocalico Township and/or East Cocalico Township Authority
for all costs and expenses incurred as a result of wastewater being
either directly or indirectly discharged into the collection system,
of such characteristics and/or quantity resulting in the need to repair,
clean, replace and/or maintain the collection system.
The owner of each improved property connected
to the wastewater system shall be responsible for all acts of tenants
or other occupants of such improved property insofar as such acts
shall be governed by provisions of this article and requirements.
The failure of the Borough of Adamstown and/or
East Cocalico Township and/or East Cocalico Township Authority to
insist upon strict performance of this article or any of the terms
or conditions thereof shall not be construed as a waiver of any of
its rights hereunder.
East Cocalico Township reserves the right to
adopt, from time to time, such additional ordinances relating to the
Adamstown POTW as it shall deem necessary and proper in connection
with use and operation of the wastewater system, which ordinances
shall become and shall be construed as part of this article.
