It is the intent of the Township of Hempfield to organize a Joint Municipal
Authority under the Municipality Authorities Act of 2001, 53 Pa. C.S.A. Section
5601, et seq., as hereafter amended, supplemented, modified or reenacted by
the General Assembly of Pennsylvania.
The name of the Authority shall be: Crabtree Area Municipal Authority.
The proposed Articles of Incorporation of the Authority are as follows:

A.
In compliance with the Municipality Authorities Act of
2001, the Township of Hempfield, Township of Salem and Township of Unity,
Westmoreland County, Pennsylvania, desiring to incorporate a Joint Municipal
Authority, does hereby certify:
(1)
The name of the Authority shall be: Crabtree Area Municipal
Authority.
(2)
Said Authority is formed under the Municipality Authorities
Act of 2001, June 19, P.L. 287, No. 22, as hereafter amended, supplemented,
modified or reenacted by the General Assembly of Pennsylvania.
(3)
The following Joint Authority has been created by the
Township of Hempfield, pursuant to the Act of May 2, 1945 (P.L. 382, No. 164),
known as the Municipality Authorities Act of 1945, and is in and for the Township
of Hempfield:

The Western Westmoreland Municipal Authority created by the Township
of Hempfield pursuant to Ordinance No. 72-1 dated the 2nd day of February,
1972. Said Authority is a Joint Municipal Authority consisting of the Township
of Hempfield, Township of Penn, Township of North Huntingdon, Borough of Irwin,
Borough of North Irwin, and the Borough of Manor.

B.
The projects authorized to be undertaken by the Authority
within the meaning of 53 Pa. C.S.A. § 5607(c) shall be the financing,
maintenance, construction and expansion of a sanitary sewer treatment facility
and a community sanitary sewer system within the portions of the Township
of Salem, Unity and Hempfield as are delineated in a certain intermunicipality
service agreement, which has previously been approved by each of the municipalities,
and as the aforementioned intermunicipality service agreement may from time
to time be amended hereafter. The Authority shall also have the power to engage
in such other projects, which are hereafter authorized by an ordinance adopted
by each of the governing bodies of the Townships of Salem, Unity, and Hempfield.
C.
Term of existence. The term of the Authority shall be
perpetual.
The officers of the Township of Hempfield are authorized and directed
to execute, under its corporate seal, the Articles of Incorporation of the
proposed Authority in substantially the form set forth in this article, and
such officers are authorized to do all acts necessary or appropriate to effect
the incorporation of the proposed Authority.
