GENERAL REFERENCES
Reporting of occupants of certain multiple dwellings — See Ch. 57, Art. II.
This chapter shall be known as the "Hempfield Township Condominium Registration Ordinance."
A. 
The following words or phrases, as used herein, shall have the meanings indicated:
CODE OF REGULATIONS
Such governing regulations as are adopted pursuant to the Pennsylvania Unit Property Act, the Act of July 3, 1963, P.L. 196, Art. I, Section 101 et seq. (68 P.S. § 700.101 et seq.) for the regulation and management of property units, including such amendments thereto as may be adopted from time to time.
DECLARATION PLAN
A survey bearing the seal of a registered architect or licensed professional engineer certifying that the declaration plan fully and accurately shows the property, the location of the building thereon, the building and the layout of the floors of the building, including the units and the common elements, and sets forth the name by which the property will be known and the unit designation for each unit therein.
UNIT
A part of the property designed or intended for any type of independent use, which has a direct exit to a public street or way or to a common element or common elements leading to a public street or way, and includes the proportionate undivided interest in the common elements, which is assigned thereto in the declarations or any amendments thereof.
B. 
All other terms herein which are not specifically defined shall be given their usual and customary meaning except if defined in another manner by the Pennsylvania Unit Property Act.
Every person, firm, partnership, corporation and other legal entity that is required to record in the office of the Recorder of Deeds a code of regulations, and any amendments thereto, and/or a declaration plan, and any amendments thereto, must, within 30 days after the recording of the same, file a true and correct copy of the same with the Ordinance Office of Hempfield Township, Westmoreland County, Pennsylvania. A fee of $10 shall be charged for such filing.

Any person, firm, partnership or corporation who or which shall violate the provisions of this chapter shall, when found by the District Justice to have violated this chapter, be subject to a civil fine not to exceed $600, plus all court costs and reasonable attorney's fees incurred by Hempfield Township in the enforcement of this chapter in a civil enforcement proceeding. Further, the appropriate officers or agents of the Township of Hempfield are hereby authorized to seek equitable relief, including injunction, to enforce with this chapter.
