The following rules and regulations shall be applicable to all parks, open space and recreation areas of the Township of Upper Gwynedd.
A. 
All parks, open spaces and recreation areas shall be open to the public between the hours of 6:00 a.m. local prevailing time and sunset, and no person or persons shall be in, on or about the above premises during the prohibited times, except those persons going to or from a scheduled event at the Nor-Gwyn Swimming Pool or Boy Scout, Girl Scout or community events at the Township Building or the Community Building or meetings of the Board of Commissioners or any other board or agency of the Township; on Township business; on police business; going to or from scheduled events at the Township Building; or residents and guests of the residents of the homes within the tract.
B. 
Parking. Motor vehicles may not be parked within the parks or recreational areas except in designated parking areas. No vehicles shall be parked overnight without the approval of the Township.
C. 
Unauthorized motor vehicles, whether licensed or unlicensed, including motorbikes, motorcycles, minibikes, snowmobiles and any other motorized vehicles or cycles, are not permitted within the parks, open space or recreational areas.
D. 
The following activities and uses are prohibited:
(1) 
Camping.
(2) 
Hunting.
(3) 
Shooting.
(4) 
Trapping.
(5) 
Metal detecting.
(6) 
The use of firearms, air rifles, spring guns, bows and arrows (except on a defined range approved by the Police Department), slingshots, BB guns or rifles, darts or any other missiles or projectiles.
(7) 
Destruction of or interference with wildlife or their nests or resting or breeding places.
(8) 
Open burning.
(9) 
Private gardens.
(10) 
Organized team and/or league sports, except at the Nor-Gwyn Swimming Pool or with approval of the Township Manager.
(11) 
Alcoholic beverages. Drinking and/or possession of alcoholic beverages is prohibited in any park, open space or recreation area of Upper Gwynedd Township.
(12) 
Careless and/or dangerous activities are prohibited in any park, open space or recreational area of Upper Gwynedd Township.
(13) 
Use of tobacco products: the smoking or use of any tobacco product. "Tobacco product" includes any product containing made or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff and any electronic device that delivers nicotine or other substances to the person inhaling from the device, but excluding any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product.
E. 
Animal control. No animals are allowed in the park or recreational areas unless attended and controlled by a leash. The individual in charge of an animal entering any park or recreational area is required to be in possession of proper implements for the gathering and disposing of animal feces. All feces will be collected immediately, removed from the park or recreational area and disposed of in accordance with accepted sanitary standards.
F. 
Fires. Fires may be built only in fireplaces provided or in grills brought to the park for this purpose. All fires will be extinguished before leaving. Campfires or fires for use in conjunction with scouting or social activities which cannot be accommodated in existing fireplaces or grills may be permitted upon application to and upon written approval from the Township Manager.
G. 
Respect for park property. Cutting, mutilating, removing or taking away of trees, shrubs, plants or flowers or the removal, defacing or damaging of any park or recreational area property is prohibited.
H. 
No person shall be present in any Township park, open space or recreational area while under the influence of intoxicating beverages, drugs or other controlled substances.
I. 
All use of any indecent, lewd or vulgar language is prohibited.
J. 
Disorderly conduct as defined in statutes of the Commonwealth of Pennsylvania, ordinances of the Township of Upper Gwynedd or in the common law is prohibited.
K. 
No vehicle can be repaired mechanically, washed, painted or have any other work performed on it within the confines of the Township parks, open space or recreation areas.
L. 
The following activities are prohibited in Township parks, open spaces and recreational areas, except that same may be conducted only after a permit has been obtained from the Township:
(1) 
Group picnics.
(2) 
All other group activities.
All permits shall be obtained from the Township office and shall be issued by the Township Manager if the application clearly shows that the activity or activities are within the purpose, meaning and spirit of this article and not prohibited by this article. The Township Manager may refer all requests for permits to the Board of Commissioners.
No exceptions to these rules shall be made by any person, except that any person requesting exception or exceptions may direct such request, in writing, to the Township Manager, who shall refer such request to the Board of Commissioners for any action, and such action shall be taken at a regular public meeting of the Commissioners.

A. 
Any person or persons, firm or corporation who shall violate any of the provisions of this article, upon conviction thereof, shall be liable to pay a fine or penalty not to exceed $1,000 plus costs of prosecution for each and every offense. All fines and penalties imposed by this article are recoverable by summary proceedings before the Magisterial District Judge, and all suits or actions at law instituted for the recovery thereof are to be in the name and for the use of Upper Gwynedd Township, against which the offenses are committed. In default of payment of any fine or penalty imposed by any Magisterial District Judge under the provisions of this article, the person or persons so offending may be committed to the Montgomery County Prison for a period not exceeding 30 days.

B. 
Each day a violation is committed shall constitute a separate offense and shall be punishable as such hereunder.
C. 
This section shall not preclude the Township from any other remedy it may have at law or equity.

A. 
The playground shall be open at 7:00 a.m. Closing time shall be 5:00 p.m. from November through February; 6:00 p.m. from March through April; 7:00 p.m. for May, September and October; and 8:30 p.m. from June through August. All times are prevailing times.
B. 
All users of the playground shall wear appropriate footwear; no bare feet are allowed.
C. 
No pets shall be allowed.
D. 
No food or drink shall be consumed in the playground, and no smoking is allowed.
E. 
The use of roller blades, bicycles, tricycles or skateboards is prohibited.
F. 
The operation of any motorized vehicle of any kind is prohibited, except as may be required by any handicapped person.
G. 
Use of the playground by organized groups consisting of 10 or more persons shall be by permit only.
These rules and regulations are in addition to all other rules and regulations governing the use of Township parks and open space facilities as set forth in Chapter 134, Article I, of the Upper Gwynedd Township Code.
Any violation of these rules shall be subject to the penalties set forth in § 134-4 of this chapter.
