§ 155-29.21 Township's right of access.

The Township shall have the right of access at reasonable times to any part of any improved property served by the sewer system as shall be required for purposes of inspection, measurement, sampling and testing and for performance of other functions relating to service rendered by the Township through the sewer system.

§ 155-29.22 Additions and amendments.

The Township reserves the right to amend the provisions of this Part 1 from time to time as it shall deem necessary and proper in connection with the use and operation of the sewer system or as may be required to meet necessary costs and expenses.

§ 155-29.23 Variance of provisions.

No officer or employee of the Township is authorized to vary the provisions of this Part 1 without action by the Board of Township Commissioners.

§ 155-29.24 Control of service.

The Township shall not be liable for a deficiency or failure of service when occasioned by an emergency, required repairs or failure from any cause beyond control. The Township reserves the right to restrict the use of sewer service whenever the public welfare may require it.

§ 155-29.25 Information required of owner.

Each owner must give the Township written notice of his address, any change of address, any change of ownership and of the use or uses of any improved property or any part thereof or any change in such use or uses.

§ 155-29.26 Violations and penalties.

A. Any person or persons, firm or corporation who shall violate any of the provisions of this Part 1, upon conviction thereof, shall be liable to pay a fine or penalty not to exceed $1,000 plus costs of prosecution for each and every offense. All fines and penalties imposed by this Part 1 are recoverable by summary proceedings before the Magisterial District Judge, and all suits or actions at law instituted for the recovery thereof are to be in the name and for the use of Upper Gwynedd Township, against which the offenses are committed. In default of payment of any fine or penalty imposed by any Magisterial District Judge under the provisions of this Part 1, the person or persons so offending may be committed to the Montgomery County Prison for a period not exceeding 30 days.

B. Each day a violation is committed shall constitute a separate offense and shall be punishable as such hereunder.

C. This section shall not preclude the Township from any other remedy it may have at law or equity.

§ 155-29.27 Return check charge.

There is hereby imposed upon any person making payment of any rental or fee described in Articles I through VI a fee, in an amount determined by resolution of the Board of Commissioners, for any such check returned marked "insufficient funds."
