No person shall in anywise injure or destroy
any ornamental or shade tree planted along the streets or sidewalks
in Cuba Village, New York.
No person, company or corporation shall lay
any gas pipes in such a way as to interfere with the roots of any
shade trees in the streets of Cuba Village, New York, nor shall any
person, company or corporation make any connecting joints with any
gas pipe within 10 feet of any shade tree which may be in the streets
of this Village. Any leaks of gas pipes occurring within 10 feet of
any shade tree in the streets of this Village shall be immediately
repaired by the person or corporation owning the same, and if said
person or corporation shall neglect to repair the same for a period
of 24 hours after notice, they shall be liable to a penalty for each
day thereafter said leak or break shall be permitted to remain unrepaired.
Any person committing an offense against any
provision of this article shall, upon conviction, be guilty of a violation
pursuant to the Penal Law of the State of New York, punishable by
a fine not exceeding $250 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment.
