The Planning Board and Zoning Board of Appeals of the Village of Liberty each consist of five Members. At times, due to conflicts of interest, illness or absence, the Planning Board and Zoning Board of Appeals either do not have a quorum sufficient under law to proceed or do not have a super-majority sufficient to address various issues for which the law requires a super-majority vote. As such, the Village Board is creating new positions for each Board, to be known as "alternate members of the Planning Board of the Village of Liberty" and "alternate members of the Zoning Board of Appeals of the Village of Liberty," respectively.
The Mayor of the Village of Liberty is hereby authorized to appoint alternate members of the Planning Board of the Village of Liberty and alternate members of the Zoning Board of Appeals of the Village of Liberty, which appointments shall be subject to the approval of the Board of Trustees of the Village of Liberty. Each alternate member shall be appointed for a term of two years.
In the event that any member of the Planning Board or the Zoning Board of Appeals is unable to participate in any application or matter as a result of a conflict of interest, illness or absence, the Chairperson of such Board may designate an alternate member of such board to substitute for such member who is unable to participate. When so designated, the alternate member shall possess all of the powers and responsibilities of the member of the respective Board who is unable to participate. Such designation shall be entered into the minutes of the initial Board meeting at which the substitution is made.
All of the provisions of state law and any other applicable local law relating to Planning Board or Zoning Board of Appeals member training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal, and service on other boards shall also apply to alternate members.
This local law is hereby adopted pursuant to the provisions of § 10 of the Municipal Home Rule Law and § 10 of the Statute of Local Governments. It is the intent of the Village Board of Trustees, pursuant to section 10 of the Municipal Home Rule Law, to supersede the provisions of Village Law § 7-712 with respect to the appointment of members to the Zoning Board of Appeals and Village Law § 7-718 with respect to the appointment of members to the Planning Board.
