A. 
Whenever any provision of this Code or any City contract shall require submission of a certificate of insurance or policy of insurance naming the City of Newburgh as a named insured, such policy or certificate shall be written on an occurrence basis as opposed to a claims-made basis. No certificate of insurance or policy of insurance which fails to meet the requirements of this section shall be accepted or approved by the City of Newburgh or any officer or employee thereof.
B. 
In the event that the City Manager determines, after diligently looking into the matter, that a policy or certificate of insurance cannot reasonably be obtained by the person submitting it to the City, then he may waive this requirement by endorsing the document "Requirement of an Occurrence Policy is Waived" and signing the same.
