As used in this chapter, the following terms shall have the
meanings indicated:
An acceptable air gap, reduced-pressure-zone device or double-check-valve
assembly as used to contain potential contamination within a facility.
These devices shall be on the latest approved list of the New York
State Department of Health as being acceptable for containment control
in New York State.
The City of Newburgh, New York.
The party of a premises contracting for service to a premises,
the owner or the legally appointed agent of an owner of premises connected
with the distribution system.
Cross-connection control which isolates the consumer's
entire facility from the City's water supply system so as to
provide the protection necessary to prevent contamination of the City's
water supply system in the event of backflow from the consumer's
facility.
The presence in water of a substance that tends to degrade
its quality, whether resulting from a hazardous, aesthetically objectionable
or nonhazardous facility.
A physical connection through which a supply of potable water
could be contaminated or polluted or a connection between a supervised
supply of unknown potability.
The classification of a facility as hazardous, aesthetically
objectionable or nonhazardous in accordance with the following:
HAZARDOUS FACILITYA facility in which substances may be present which, if introduced into the City's water supply system, would or may endanger or have an adverse effect on the health of other water consumers. The City's water supply shall be protected from possible contamination from the facility by means of an acceptable air gap or a reduced-pressure-zone device.
AESTHETICALLY OBJECTIONABLE FACILITYA facility in which substances are present which, if introduced into the City's water supply system, could be a nuisance to other water consumers but would not adversely affect human health. The City's water supply system shall be protected from potential contamination from the facility by means of an acceptable air gap, reduced-pressure-zone device or double-check-valve assembly.
NONHAZARDOUS FACILITYA facility which does not necessarily require the installation of an acceptable air-gap, reduced-pressure-zone device or double-check-valve assembly but will require the installation of other types of devices to prevent backflow such as dual-check backflow preventers to be used in conjunction with internal plumbing control.
The water system of the City of Newburgh, including the source,
treatment works, pumping stations, transmission mains, distribution
system and storage facilities serving the public.
The piping laid from a water main, including the connection
to the water main for the purpose of conveying water for fire protection
from the water main into a building and shall include the gate valve
with gate box.
All plumbing, including pipe, fixtures and other devices
on the house side of the official water meter of the service line.
A physical connection between two or more supervised water
supply systems.
A plumber licensed by the City of Newburgh.
A meter designated by the Superintendent as being the water
meter used to register the water consumption, and shall include the
remote receptacle attached thereto, complete with wiring.
A consumer who utilizes water supplied by the City to an
improvement outside the City limits.
Any individual or individuals, partnership or corporation
or any similar type of business organization, whether for profit or
otherwise, in whose name title to a building stands.

Prevention and elimination of cross-connections within the
consumer's water system by enforcement of Building and Plumbing
Codes.[1]
The piping laid from a water main other than a fire service
line, including the connection to the main for the purpose of conveying
water from the City water distribution system into a building or property,
to and including the official water meter, and shall include the gate
valve with gate box or corporation stop and curb stop with curb box.
The Superintendent of the Water Department of the City of
Newburgh or his duly authorized representative.
The Water Department of the City of Newburgh and all employees
thereof.
The water pipe laid in a street, right-of-way, easement or
other public ground and forming part of the water distribution system
of the City.
The Superintendent is authorized and empowered to investigate
and inspect any and all conduits, mains, valves, plant buildings,
other structures, machinery, appliances and all other equipment used
in conjunction with the delivery and disposal of sewage, water, gas
or electricity and to make any and all tests in connection with such
investigation and inspection which may be deemed advisable to ascertain
the condition thereof.
The Superintendent is authorized and empowered to issue and enforce such orders for removal, replacement or repair for any of the items specified in § 293-2, as deemed proper for the best interest of the City and for the protection of property and preservation of the safety, health and general welfare of the inhabitants thereof.
The Superintendent, upon giving notice thereof, is authorized and empowered to enter upon any property or building for the purpose of conducting the investigation and inspection provided for in § 293-2.
No person shall, in any manner, interfere with the Superintendent in the performance of the powers conferred by this chapter or shall prevent or interfere in the inspection, examination, investigation or test as provided in § 293-2.
The Superintendent shall notify, in writing, the City Assessor
and the customer whenever a water meter is installed.
No person shall attach a water meter to or detach one from the
municipal water system or in any way adjust, alter, change or in any
other way interfere with any water meter or water supposed to pass
through any water meter attached to a water service pipe, unless with
the approval of the Superintendent.

A.
The owner of any house, building, or property used for human occupancy,
employment, recreation, commercial or other purpose, situated within
the City, is required, at such owner's expense, to install waterline
facilities and connect such facilities directly to the City's
water supply and distribution system in accordance with the provisions
of this chapter.
B.
No person shall use or take water from the municipal water system
without permission from the Superintendent. New building operations
which require water must make the necessary connections to the water
system and install meters before drawing any water.
No service pipe from the main to the curb shall be covered until
it has been inspected and approved by the Superintendent.
The management of the Water Department shall be vested in an
employee, to be known as the "Superintendent of the Water Department,"
who shall be appointed by the City Manager. Whenever this chapter
confers some power or authority upon the Superintendent, the Superintendent
may delegate that power or authority to another employee or employees
of the Water Department.
All services and premises connected with the distribution system
must be metered.
