A.
The Board of Ethics in existence at the time of the
enactment of this article is dissolved.
B.
There is hereby established a Board of Ethics consisting
of three members to be appointed by the Town Board.
C.
The members of the Board of Ethics shall be appointed
at the first regular Town Board meeting after this Act becomes effective.
The first appointment shall be for a term expiring on December 31,
2008. The second appointment shall be for a term expiring on December
31, 2007. The third appointment shall be for a term expiring December
31, 2006. Members of the Ethics Board whose terms have expired may
continue to serve on the Ethics Board until a replacement is appointed.
Each appointment to fill an expired term shall be for a term of three
years. Appointments to the Ethics Board shall be made at the Town’s
organizational meeting.
D.
Each member of the Board of Ethics shall be a resident
of the Town of North Greenbush.
E.
The Chairman of the Board of Ethics shall be appointed
for a one-year term at the Town’s organizational meeting. The
Chairman must be the unanimous choice of the Town Board.
F.
No Ethics Board member may be removed except upon
cause and by the unanimous vote of the Town Board.
G.
No political party chairman may serve on the Ethics
Board.
H.
This section of the Town’s law is specifically
intended to supersede those portions of General Municipal Law § 808(3)
allowing members of the Board of Ethics to serve “at the pleasure
of the appointing authority” and requiring the Town Board to
“include at least one member who is an elected or appointed
municipal officer or employee.”
The Board of Ethics established hereunder shall
render advisory opinions to Town employees or the Town Board upon
a duly notarized written request by a Town employee or a resident
and registered voter of the Town of North Greenbush. The Board of
Ethics may seek the advice of the Town Attorney, a Deputy Town Attorney
or counsel employed by the Board of Ethics in rendering its opinion.
Such Board of Ethics, upon its formation, shall
promulgate its own rules and regulations pursuant to Roberts Rules
of Order. It shall maintain appropriate records of its opinion and
proceedings and shall make recommendations to the Town Board as it
sees fit.
