[Adopted 1-27-1981 by L.L. No. 2-1981 as Ch. 63 of the 1981 Code]
By the adoption of this article, the Town Board of the Town of North Greenbush declares its intent to be to regulate, in a manner consistent with the interests of the citizens of the Town of North Greenbush, the dumping of offal, garbage, trash, refuse, rubbish, debris and like waste materials on lands within the Town.
Garbage is a deleterious substance. Unattended, private and public garbage dumps and disposal areas emit noxious odors and fumes, attract rodents and vermin and become breeding places therefor. All these conditions can adversely affect the developing of the Town unless they are properly and carefully regulated. Therefore, recognizing the above and the needs of our Town and in the exercise of its police power in these regards, the Town Board of the Town of North Greenbush does hereby enact this article.
A.
No lands, either public or private, within the Town of North Greenbush, other than a public dump or dumping grounds hereafter established by this Town, shall be used as a dump or dumping ground in said Town by any person or persons. Such terms "person or persons" shall include all individuals, firms, partnerships, corporations, municipalities or municipal corporations and association of persons.
B.
The use of land, either public or private, as a dumping ground prohibited hereby shall mean the use of such land for the deposit thereon of all offal, garbage, trash, refuse, debris and like waste.
This article shall not prohibit the establishment by resolution of the Town Board of public dumps or dumping grounds from time to time as the necessity therefor shall arise, and the regulation and use of such public dumps or dumping grounds shall be set forth and established by resolution of the Town Board.
[Amended 6-9-1988 by L.L. No. 2-1988; 11-14-1991 by L.L. No. 9-1991]
