No person shall injure or disturb any pavement,
sidewalk, crosswalk or sewer or dig or excavate in any street or public
place nor move any earth or stone or other material therefrom within
the Village without permission, in writing, from the Superintendent
of Public Works and under such terms and conditions, including the
furnishing of a bond or other security, as the Superintendent of Public
Works may impose, and the Superintendent of Public Works may order
any excavation made contrary to the provisions of this section to
be filled up or altered at the expense of the person making the same.
Whenever any public street within the Village
is in the process of construction or whenever any excavation is being
made in such street, it shall be the duty of the person performing
the work to place and maintain such sufficient guards, including lights
in the nighttime, about such construction or excavation as to secure
public safety until said street is ready for public use, and such
guards and lights shall in all respects, including kind, manner and
location, be subject to the approval of the Superintendent of Public
Works.
No person shall place or deposit, except as
hereinafter provided, on any sidewalk or in any street any sign, cask,
box, stone, sand, vehicle, lumber or other substance or materials
of any sort. The owner or occupant of the premises in front of which
any such article, substance or material is placed or deposited shall
remove the same forthwith or the Superintendent of Public Works may
remove or cause to be removed any such obstruction and charge the
same to any such owner or occupant.
A.
The Superintendent of Public Works may grant permission,
in writing, to any person to place and keep any building materials
in any public street or place in the Village for the purpose of construction
or making repairs, for a period not to exceed three months.
B.
The Superintendent of Public Works shall establish
the terms and conditions, including the furnishing of a bond or other
security, under which the permit shall be granted. Such permit shall
provide for the portion of the sidewalk or street to be obstructed,
and it shall be discretionary with the Superintendent of Public Works
as to what part of any street or sidewalk may be so obstructed.
C.
Such permission may, at any time, be revoked by the
Superintendent of Public Works without notice.
Any person to whom permission is granted as
aforesaid shall cause all said materials to be enclosed with sufficient
guards as to secure public safety and at all times during the night
shall keep lighted thereon warning lights, and such guards and lights
shall in all respects, including kind, number and location, be subject
to the approval of the Superintendent of Public Works.
All such building material or rubbish arising
therefrom shall be removed from the street by the party to whom said
permission was granted at the expiration of the time limit as provided
by the permit or upon the revocation thereof by the Superintendent
of Public Works.
All persons obstructing a street or sidewalk
as hereinabove provided shall leave such street or sidewalk in as
good condition as the same was prior to being so obstructed, and in
case any person shall fail to comply with this provision, the Superintendent
of Public Works may perform the necessary work upon such street or
sidewalk and charge the same to the person in default or to the owner
of the property for whose benefit said obstruction was made.
Any person who shall make any excavation adjacent
to and within four feet of the boundary line of any public street
or place within the Village shall erect sufficient barriers between
said street and said excavation to secure public safety and at all
times during the nighttime shall keep lighted warning lights upon
said barriers in such a manner as to give warning thereof. It shall
be the duty of any person making such excavation to notify the Superintendent
of Public Works of the same, and said person shall comply with any
directions which said Superintendent of Public Works may give relative
to the same.
In case of the failure of any person to properly
barricade and light any excavation or construction as herein provided,
the Superintendent of Public Works may place such barriers and lights
at the expense of the person so in default or of the owner of the
property for whose benefit said excavation or construction is being
made.
No unauthorized person shall remove, mutilate
or interfere with any lights, warning signals or barriers erected
for public safety or any street sign or any monument placed to locate
the line of any public street, sidewalk or public improvement within
the Village.
A.
No person shall ride or lead a horse or mule along
or upon any sidewalk in this Village.
B.
No person shall operate or drive any self-propelled
vehicle or equipment propelled by its own motor or power, including
bicycles, skateboards, tricycles and similar vehicles, along or upon
any sidewalk in this Village except self-propelled power mowers, snowblowers
and other similar garden or lawn equipment and self-propelled wheelchairs
or similar equipment designed for and used by handicapped or disabled
persons and bicycles operated by children under 10 years of age.[1]
No person shall construct any sidewalk on Village
streets or property except under the supervision of the Superintendent
of Public Works and in accordance with specifications established
by the Board of Trustees.
No person, except as hereinabove provided, shall
store, place or park or allow to remain stored, placed or parked in
front of property owned or occupied by him any material, boat, motor
vehicle or other article on any public sidewalk or between the sidewalk
and roadway of any street or public place.

A.
No person
shall throw, put or place, or cause to be thrown, put or placed, any
snow or ice into any street, public place or thoroughfare in the Village.
B.
No person
shall throw, put or place, or cause to be thrown, put or placed, any
snow or ice onto any private property owned by another without that
property owner's consent.
C.
The prohibitions
contained in this section shall not apply to work conducted by the
Village of North Syracuse, the County of Onondaga, or State of New
York when removing snow or ice from public highways, public rights-of-way,
public places or areas of pedestrian traffic.
No person shall sweep, throw or deposit or cause
to be swept, thrown or deposited any ashes, dirt, stone, brick, leaves,
grass, weeds or any other debris or rubbish of any kind or any water
or liquid, except for purposes of cleansing the same, of any kind
into any street, gutter or public place or on any sidewalk within
the Village.

Any violation of any of the provisions of this
chapter shall be punishable by a maximum fine of $250 or a term of
imprisonment not to exceed 15 days, or both. Each week's continued
violation shall constitute a separate, additional violation for which
no further notice of any kind needs to be filed or served.
