Upon the adoption by the Board of Trustees of the Village of Perry,
New York, of a resolution pursuant to § 22, Subdivision 3 of the
General Municipal Law, this Board may nevertheless release or return to the
insured any or all amounts to which it would be otherwise entitled to claim,
provided that the insured agrees with the Village of Perry, in writing, to
restore the affected premises to the same or improved condition that the subject
premises was in prior to the time of arising of the lien of the Village of
Perry against the proceeds, as provided for in said § 22. Such resolution
shall provide conditions which shall guarantee performance of such obligations
by the insured.
