[HISTORY: Adopted by the Board of Trustees of the Village of Poquott 3-28-1985 by L.L. No. 1-1985; amended 2-25-1993 by L.L. No. 1-1993. Subsequent amendments noted where applicable.]
There is hereby created in the Village of Poquott a Code Enforcement Bureau, the function of which shall be the enforcement of the Code of the Incorporated Village of Poquott.
The Mayor, with the consent of the Board of Trustees, may appoint a Commissioner of Code Enforcement Bureau from among the members of the active Board and set forth his duties and responsibilities.
There shall be created the position of Parking Violations Officer. Notwithstanding any provision of the Uniform District Court Act and/or the Uniform Justice Court Act, all Code Enforcement Officers shall be deemed to be a Parking Violations Officer, all of whom shall have the power to issue and serve, within the Village, appearance tickets and/or subpoenas for violation of the Vehicle and Traffic Code in cases involving nonmoving violations. Such service shall have the same force and effect as if served by a peace officer without his being a peace officer.

All Code Enforcement Officers are authorized to issue appearance tickets relating to the enforcement of the Code of the Incorporated Village of Poquott.
The Mayor and/or Commissioner is authorized to make rules and regulations as may be required for the efficient administration of such Code Enforcement Bureau and shall also provide, within the limits of any appropriation and subject to the Board of Trustees, the following:
A. 
Liability insurance for such Code Enforcement Officers that shall protect them and the Village from liability that may arise out of and in course of the performance of their respective duties.
B. 
Workmen's compensation, accident insurance, disability insurance, and/or life insurance as shall be agreed upon between the Code Enforcement Bureau personnel and the Board of Trustees.
C. 
For payment of the Code Enforcement Officers, or other Public Safety Officer employed for service rendered upon an hourly basis.
D. 
Uniform and equipment for the Code Enforcement Officers, or other public safety officer employed as may be necessary or desirable to carry out the duties of the bureau.
E. 
An annual physical examination upon which employment of reemployment shall be predicted on the successful passage of such examination.
A. 
This chapter shall take effect after publication according to law, except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York.
B. 
Any part or parts of this chapter which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York shall take effect from and after the day on which approval in writing is received from both the New York State Traffic Commission and the New York State Department of Public Works.
