A.
Any person believing himself or herself to be aggrieved
under the Americans with Disabilities Act by any action or inaction of the
Village of Port Chester, its officers or employees may file a grievance by
delivering a complaint, in writing, with the Village Clerk specifying the
matter complained of and including the name, address and, at the option of
the grievant, the writing may also specify the remedy proposed.
B.
On receipt of the grievance, the Clerk shall stamp the
date and time of filing and deliver a copy to the Village Manager.
A.
Upon receipt of the written decision of the Village Manager,
the grievant may, at his or her option, file an appeal with the Board of Trustees
by filing a written notice of appeal with the Village Clerk specifying the
portion or portions of the decision appealed from.
B.
The appeal must be filed not more than 10 days after
the mailing of the decision.
C.
On receipt of notice of appeal, the Clerk shall deliver
copies thereof to the Board of Trustees, who shall schedule a hearing at a
regularly scheduled or special meeting and direct the Village Clerk to give
the applicant written notice of the time and place of the hearing.
D.
Upon completion of the hearing, the Board shall, not
later than its next regularly scheduled meeting, render a decision.
E.
The Village Clerk shall give notice of the decision when
made to the grievant in writing.
