[HISTORY: Adopted by the Village Board of the Village of Port Chester 9-8-1992 as L.L. No. 11-1992. Amendments noted where applicable.]
A. 
Any person believing himself or herself to be aggrieved under the Americans with Disabilities Act by any action or inaction of the Village of Port Chester, its officers or employees may file a grievance by delivering a complaint, in writing, with the Village Clerk specifying the matter complained of and including the name, address and, at the option of the grievant, the writing may also specify the remedy proposed.
B. 
On receipt of the grievance, the Clerk shall stamp the date and time of filing and deliver a copy to the Village Manager.
A. 
Not later than five working days after receipt of the grievance by the village, the Manager will:
(1) 
Give notice by mail to grievant that the matter has been corrected and the manner it has been or will be done; or
(2) 
Give written notice of a meeting to attempt to resolve the grievance.
B. 
On completion of the meeting, the Village Manager shall give a written decision based on an agreement to correct, a partial rejection or a full rejection unless the grievant shall agree to a delay or further meeting.
A. 
Upon receipt of the written decision of the Village Manager, the grievant may, at his or her option, file an appeal with the Board of Trustees by filing a written notice of appeal with the Village Clerk specifying the portion or portions of the decision appealed from.
B. 
The appeal must be filed not more than 10 days after the mailing of the decision.
C. 
On receipt of notice of appeal, the Clerk shall deliver copies thereof to the Board of Trustees, who shall schedule a hearing at a regularly scheduled or special meeting and direct the Village Clerk to give the applicant written notice of the time and place of the hearing.
D. 
Upon completion of the hearing, the Board shall, not later than its next regularly scheduled meeting, render a decision.
E. 
The Village Clerk shall give notice of the decision when made to the grievant in writing.
A. 
The grievant may be represented by an attorney at any or all stages of the proceedings under this chapter.
B. 
The village may, at its option, provide for stenographic minutes of any meeting or hearing, but there shall be no obligation to do so.
