This chapter shall be known as "Chapter 143, Billiards, Bowling and Shooting Galleries, of the Code of the Village of Port Chester" and shall apply within the Village of Port Chester.
No public billiard or pocket billiard room or public place of any description
in which billiards or pocket billiards are played or which includes any apparatus
or paraphernalia for the playing of billiards or pocket billiards and which
is conducted as a public place of business for profit shall be permitted in
the Village of Port Chester unless a license, as provided for in this chapter,
is obtained annually by the proprietor.
No public bowling alley or public place of any description in which
bowling is conducted or which includes any apparatus or paraphernalia for
bowling and which is conducted as a public place of business for profit shall
be permitted unless a license therefor is obtained annually by the proprietor
as provided in this chapter. There is excluded from the licensing requirements
hereof, however, wholesale and retail establishments selling bowling equipment
and paraphernalia.
No building, structure, barn or target area open to the public and operated
as a shooting gallery for a fee or profit shall be kept, operated or maintained
unless a license for the same has been obtained.
A.
Prior to the opening of any of the establishments, the
owner and/or operator of the same shall make application to the Village Clerk
for a license. The Clerk shall refer the application to the Chief of Police
and the Port Chester Building Department for investigation and report.
B.
If either of these reports is negative, the Village Clerk
shall reject the application and shall give notice to the applicant thereof
and shall also notify the applicant of a right, within 10 days after notice
of denial, to request a hearing before the Village of Port Chester Board of
Trustees, such request shall be in writing and filed with the Village Clerk,
who shall notify the Board so a hearing can be set.

In the event that there shall be three or more violations of state and/or
village laws at the location in any twelve-month period resulting in convictions,
the Village Clerk shall notify the Board of Trustees, who will notify the
license holder to appear before it to be heard on the question of whether
the license should be suspended or revoked.
With respect to billiard and pocket billiard tables, there shall be
not more than a total of two tables permitted in any billiard or pocket billiard
parlors or establishments.
The license required by this chapter shall at all times be prominently
displayed.
A violation of any of the provisions of this chapter, including failure
to obtain a license, shall constitute a violation and shall subject the owner,
manager, operator, tenant or any other person in charge of the establishment
to a fine of $250 for each such violation. Each day's violation shall
be a separate and distinct violation and subject the violator to a further
fine of $250.
