The public parks of the Village of Port Chester under the jurisdiction of the Port Chester Park Commission shall be open to the general public between the hours of dawn to dusk, and no person or persons shall be permitted in such parks between the hours of dusk to dawn, except those so authorized by the Park Commission, the Recreation Commission and the Board of Trustees.
No person shall deposit, throw or leave exposed in any park of the Village of Port Chester any rubbish, garbage or refuse matter of any kind, nature or description except in enclosed containers provided by the Park Commission.
No person shall destroy, cut, break, deface, mutilate, injure, disturb, sever from the ground or remove any plant, flower, flower bed, shrub, tree, growing thing, plant growth or any branch, stem or leaf thereof; or attach any rope, cable or other contrivance thereto; or set fire or assist another to set fire to any timber, trees, shrubs, plants, flowers, grass or plant growth; or enter or walk upon any planted place in any public park in the Village of Port Chester.
No person shall injure, damage, deface, displace or remove any property or equipment in any public park in the Village of Port Chester, New York.

A. 
Group use.
(1) 
Any group of 20 persons or more will be required to obtain a permit in order to use a park. An application in a form provided must be completed and submitted to the Recreation Department stating the number of persons, activities planned and the hour of arrival and departure, at least 20 days prior to the date of the event.
(2) 
The request must be accompanied by a fee as set forth in Chapter 175, Fees.
(3) 
Exception; barbecuing.
(a) 
A group of 19 or under does not require a permit unless they intend to cook or have a group athletic activity in the park. If so, a permit is required.
(b) 
Outdoor barbecuing is allowed by permit and only in designated areas.
(4) 
Any type of a group athletic activity, whether in a formal league or not, requires a permit from the Recreation Department.
B. 
Insurance. For all activities insurance required is as follows: A certificate of insurance covering bodily injury and property damage in the amount of $500,000 single limit coverage must be submitted prior to the day the park is to be used. The certificate must name the Village of Port Chester as an additional insured.
C. 
Deposit. Prior to use of the park, a deposit of $100 is required for nonresidents, resident corporations and nonresident corporations and $50 is required for residents and nonprofit organizations; the Park Commission reserves the right to set the amount of the deposit. This deposit is to cover the cost of any repairs, and the balance will be returned after the area is inspected for damage and littering. Failure to comply with the rules set forth in this chapter will result in the forfeiture of the deposit.
D. 
Not-for-profit, charitable and fraternal organizations. The park fee set out in Subsection A hereof shall not be charged to such organization if proof of qualifying status is provided at the time that permit is applied for.
E. 
Vending and concessions are not allowed in any park without a permit.
F. 
Village-sponsored events are exempt from these requirements.
G. 
A permittee's failure to comply with the requirements of this section shall subject the permittee to immediate revocation or suspension of the permit.

A. 
Group sports or athletic activities not sanctioned by the Port Chester Recreation Department are not allowed in any park areas. All sports must be played in designated fields or areas of parks.
B. 
There shall be no golf activities in any park.

A. 
No dogs are allowed in any of the parks in the Village of Port Chester except for service dogs or dogs in service to the Village or other governmental agencies as defined in the State Agriculture and Markets Law.
B. 
This section shall not apply to attended dogs to and from and at a designated off-leash dog area within a park.

It is forbidden to put up any signs in the parks. By order of the Park Commission, the sign will be removed and discarded.

Any person violating the provisions of this law or any part thereof shall be liable for and forfeit a penalty not exceeding $100 for each offense. In addition thereof, said violation shall constitute disorderly conduct, and the person violating the same shall be a disorderly person.

No person shall drive or operate a motor vehicle, motorbike, motorcycle, moped, minibike, snowmobile or any other vehicle propelled by other than muscular power in the public parks of the Village of Port Chester under the jurisdiction of the Port Chester Park Commission at any time except when authorized by the Park Commission, the Recreation Commission or the Board of Trustees.

A. 
"Memorial" shall mean an object established to preserve the memory of a deceased person or event.
B. 
A memorial shall only consist of a tree or bench and an accompanying plaque.
C. 
No memorial shall be located or maintained in a Village park without the approval of the Park Commission.
D. 
The Park Commission shall promulgate regulations that will contain guidelines, standards and procedures for the donation, placement and upkeep of memorials.
E. 
Preexisting memorials in violation of this section shall be removed by the Village.
F. 
This section does not apply to the Village of Port Chester or Village-sponsored memorials.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
PARKS
All of the Village parks in the Village of Port Chester.
SMOKE
The burning of a lighted cigar, cigarette, pipe, or any other matter or substance which contains tobacco, cannabis, cannabinoid hemp or other product, including the use of an electronic smoking device that creates an aerosol or vapor.
B. 
No person shall smoke in the parks.
