A. 
Permit. No person shall construct or maintain any building drain which passes across or beneath any part of any street, road or highway, or sidewalk, unless the owner of such building shall first have obtained a permit from the Engineer.
B. 
Certificate. A certificate by the Engineer that such drain is necessary and that its construction will not damage the street or other public or private property shall be issued as a condition precedent to granting the permit.
For every application for a permit, a fee as set forth in Chapter 175, Fees, shall be paid.
No permit shall be issued unless the applicant provides insurance of the same nature and in the same amounts as provided for permits to excavate in the streets in Article I to save the Village harmless from the payment of damages for injury to persons or property because of fault or default.
