Where there are practical difficulties or unnecessary hardships in the
matter of the carrying out of the strict letter of this chapter, the Planning
Commission of the Village of Port Chester shall have the power in passing
upon any application required herein to vary or modify any of the regulations
or provisions contained herein so that the spirit of this chapter shall be
observed and public safety and welfare secured and substantial justice done.
Any person, firm or corporation who shall erect or cause to be erected
or maintained upon any premises owned by them any satellite antenna or tower
not erected or maintained in accordance with the provisions of this chapter
shall be guilty of an offense punishable by a fine not exceeding $200 per
day; however, for the purpose of conferring jurisdiction upon courts and judicial
officers generally a violation of this chapter, or any provisions or part
thereof, shall be deemed a violation and for such purposes only. Each day's
continued violation shall constitute a separate violation. Notwithstanding
the foregoing, the Village of Port Chester may, in the alternative, seek to
enforce obedience to this chapter or any part thereof by injunction to restrain
the continued violation thereof.
