This article shall govern the construction and maintenance of awnings, canopies and marquees over the sidewalks in the City.
As used in this article, the following terms shall have the meanings indicated:
CANOPY or MARQUEE
A structure of metal or wood or other approved building material which protrudes from the face of a building and overhangs or covers part of a sidewalk.
[Amended 2-26-2007 by L.L. No. 2-2007]
Minimum clearance from a sidewalk to the underside of a canopy or marquee shall be nine feet, including supporting members. Width is limited to within one foot of curbline and no supporting columns will be allowed. The structure must be supported by struts or by cantilever or other approved method, other than by posts.
Such canopy or marquee must be able to support a minimum load of 40 pounds per square foot.
The materials used and the method of installation of such structures shall be approved by the City Building Official.
A canopy or marquee is to be considered part of the building to which it is attached, and the owner of the same shall assume full responsibility for the safe maintenance and care of said structure and full liability for damages of whatsoever nature arising out of the defective or unsafe condition of said structure.
Cloth awnings may be constructed in front of any store or building within the City to project over the sidewalk not to exceed 10 feet, provided that such awnings shall be supported by iron brackets or iron framework securely attached to said building in such a manner as to be at all times safe and self-supporting, and provided that every part of such awnings shall be at least six feet six inches above the sidewalk and the iron brackets or framework attached to said awnings shall be erected at least seven feet above the sidewalk. All cloth awnings now or hereafter erected shall be supported or sustained in such a manner that they will not sink or sag below the above height.
