The Town of Bergen shall reimburse any employee
or public official who qualifies as an "insured" under the terms of
the Town's Public Officials and Employees Liability Insurance
policy for any deductible, retention, or other similar expense incurred
by the employee as the result of a lawsuit brought against him or
her.
This chapter shall only apply where the Public
Official and Employees Liability Insurance policy applies or where
said insurance policy would apply but for the fact that the claim
under the policy is equal to or less than the deductible or retention
figure.
This chapter shall take effect upon filing with
the Secretary of State, or upon the effective date of the Town of
Bergen Public Official and Employees Liability Insurance, whichever
is later.
