This chapter shall be known as "Disturbing the Peace."
The purpose of this chapter is to preserve, protect and promote the public health, comfort, convenience, safety, welfare, and the peace and quiet of the Village of Cuba and its inhabitants.
A. 
No person shall:
(1) 
Congregate in a group which impedes and/or obstructs the passage of pedestrians or vehicle traffic; or
(2) 
Act in a disorderly manner or disturb the peace and quiet of the Village or any lawful meeting or assemblage therein; or
(3) 
Engage in any act, amusement or practice endangering property or person(s); or
(4) 
Operate or permit to operate any mechanical or electronic device for the production or amplification of sound in such a manner as to cause public inconvenience, annoyance or alarm within the Village.
B. 
This chapter shall not apply to the lawful sounding of emergency vehicles, fire sirens, fire whistles or alarms, or the ringing of church bells.
Nothing herein shall be construed to impede or restrict the people's right to lawfully assemble or redress their grievances, or restrict their right to freedom of speech.
A. 
Each violation of this chapter shall be punishable by a fine of not less than $50 nor to exceed $250, or by imprisonment for a term not to exceed 15 days, or by both such fine and imprisonment.
B. 
For purposes of the Criminal Procedure Law, a violation hereunder shall be classified as a local law violation or petty offense.
C. 
The court shall have all powers delegated to it, as applicable, under New York Criminal Procedure Law § 420.10.
