Village of Cuba, NY Chapter 161 Smoking

§ 161-1 Prohibited smoking areas.

Smoking is prohibited in the following areas:

A. Any indoor enclosed work area occupied by more than one person, unless all employees in such area agree to allow smoking. The rights of a nonsmoker to a smoke-free area shall prevail.

B. All employee rest rooms, hallways, the office of the Mayor, office of the Clerk/Treasurer and areas containing office equipment used in common.

C. The office of the Superintendent of Public Works.

D. Conference or meeting rooms and in municipal vehicles used by more than one person, unless all occupants agree to allow smoking.

§ 161-2 Designated smoking areas.

An enclosed smoking room may be designated upon request if space is available.

§ 161-3 Conflicts and violations.

A. Conflicts should be brought to the attention of the appropriate supervisory personnel.

B. Employees found smoking outside of designated smoking areas will be considered in violation of this policy and may be subject to penalties.

§ 161-4 Posting and distribution of policy.

Copies of these rules will be posted and distributed to all employees and to all prospective employees upon request.

§ 161-5 Enforcement.

Any Cuba Village officials shall be designated an agent to assist in the enforcement of this policy by notifying employees who are in violation.

§ 161-6 Amendments.

This policy may be amended from time to time by resolution by the Cuba Village Board. All amendments shall be in conformance with New York State laws and employees will be notified accordingly.
