The purpose of this chapter is to protect the public health,
welfare and safety by regulating the operation of snowmobiles on public
highways and places in Cuba Village in a manner which will be compatible
with the use of such highways and places for vehicular and pedestrian
travel and other uses and which will promote the safe and proper use
of snowmobiles for recreation and commerce and minimize detrimental
effects of such use on the environment.
The operation of snowmobiles on highways and public ways of Cuba Village shall be subject to the applicable provisions of Article 21 of the Parks, Recreation and Historic Preservation Law, the rules and regulations of the Office of Parks, Recreation and Historic Preservation and the rules, restrictions and conditions set forth in § 165-5 of this chapter.
A.
The operation of snowmobiles solely for the purpose of travel between
the residences of the owners and areas outside of the village may
be permitted on all streets in Cuba Village.
B.
Travel shall be on the right edge of the street or on the shoulder
next to the snowbanks.
C.
There shall be no operation of snowmobiles on sidewalks or pedestrian
pathways within the village.
No snowmobiles may be operated in designated areas in the village
park in the vicinity of skating, sliding, skiing and other activities.
The operation of snowmobiles within Cuba Village is subject
to the following conditions and restrictions:
A.
Prohibited operating hours. No person shall operate snowmobiles on
any village street between the hours of 11:00 p.m. and until after
daylight, except to gain access to and from snowmobile areas.
B.
Direction of operations. No person shall operate a snowmobile within
the village except on the right side of a highway or highway right-of-way
and in the same direction as highway traffic.
C.
No person under 16 years of age shall operate a snowmobile on the
village streets unless accompanied by a parent, guardian or relative
willing to accept parental responsibility.
D.
No snowmobile shall be operated on a village street at a speed of
more than 15 miles per hour.
E.
No snowmobile shall be operated on private property other than land
owned by the operator or his/her immediate family unless written consent
for such operation is given by the owner of such property.
F.
Each person operating a snowmobile on a village street shall observe
strictly all vehicular traffic signs and signals and all other rules
and regulations applicable to vehicular traffic and shall obey the
orders and directions of any state or local police or other law enforcement
officer authorized to direct or regulate traffic.
G.
All snowmobiles operated within the village shall be equipped with
adequate headlights, braking system, muffler and other equipment as
prescribed by § 25.17 of the Parks, Recreation and Historic
Preservation Law, and all operations shall be subject to the conditions
set forth in § 25.03 of the Parks, Recreation and Historic
Preservation Law.[1]
Except as provided in § 27.11 of the Parks, Recreation
and Historic Preservation Law with respect to offenses against traffic
regulations, any offense against the provisions of this chapter shall
be deemed a violation pursuant to the Penal Law of the State of New
York, punishable by a fine of not more than $100 or imprisonment for
not more than 15 days, or both.
This chapter shall take effect immediately upon its filing in
accordance with the provisions of § 27 of the Municipal
Home Rule Law; provided, however that no snowmobile shall be operated
under the provisions hereof until such time as the signs and markers
are installed or constructed in accordance with Title D of the Parks,
Recreation and Historic Preservation Law and the rules and regulations
of the New York State Office of Parks, Recreation and Historic Preservation
and the Department of Transportation.
