GENERAL REFERENCES
Streets and sidewalks — See Ch. 173.
The Village Board finds that it is in the general welfare of the Village
of Groton to provide for the regulation of the use of the Village of Groton
Freestyle Sports Facility to promote the safety of its users and the maintenance
of the property. The provisions of this chapter are intended to promote the
health, safety and general welfare of the Village by providing for the regulation
of the use of such facilities.
As used in this chapter, the following terms shall have the meanings
indicated:
Any bicycle with a twenty-inch wheel.
The "Groton Freestyle Sports Facility."
Manufactured or assembled devices consisting of a shoe boot with
a blade-like runner approximately three to four inches in thickness mounted
or permanently attached thereto in a frame across the length of such shoe
boot, with such blade-like runner containing three, four, or five wheels designed
to minimize friction with any surface with which they come in contact and
which are aligned along the length of the runner in more or less a straight
line, and used to skate or glide by means of human foot and leg power.
Manufactured or assembled devices, each consisting of a frame or
shoe having clamps or straps, or both, for fastening, with a pair of small
wheels near the toe and another pair at the heel mounted or permanently attached
thereto, for skating or gliding, by means of human foot and leg power.
Manufactured or assembled device consisting of a narrow board of
wood, plastic, fiberglass or similar material with roller-skate or other type
of wheels attached to each end, without a mechanism or other device for steering,
and used to skate or glide by means of human foot and leg power.
A.
All skaters must have a day use pass or a current Groton
Freestyle Facility annual pass to use the facility.
B.
Fees for such passes shall be established by the Village
Board of Trustees and may be amended from time to time.
C.
All skaters must have a liability waiver on file with
the Village. For skaters under 18 years of age, a parent/guardian must sign
release forms in person or have the forms notarized.
A.
The Groton Freestyle Sports Facility is for skateboarding,
BMX bikes, and roller-blading only. All other uses are prohibited.
B.
Minimum age is six years old.
C.
All park users must wear appropriate bicycle helmets
(buckled) at all times. Elbow and knee pads are recommended. Failure to wear
helmets may result in loss of park privileges and/or citation. Any safety
equipment used must meet the standards of either the American Society for
Testing and Materials (ASTM) or the U.S. Consumer Products Safety Commission
(CPSC) or standards established by those entities subsequent to the adoption
of this section.
D.
No food or beverage or food or beverage container shall
be permitted inside the facility.
E.
In addition, alcoholic beverages, smoking and chewing
gum/tobacco are prohibited inside the facility.
F.
All equipment used by skaters must be in good condition
and not cause damage to the facility or its structures.
G.
The Village of Groton is not responsible for personal
property.
H.
Spectators are not permitted inside the facility.
I.
The Village of Groton should be notified immediately
of any unsafe conditions found inside or outside the facility.
J.
No contests of any sort are allowed in the facility unless
organized by the Village of Groton and/or the Town and Village of Groton Joint
Recreation Committee.
K.
The Village of Groton reserves the right to change the
park schedule and/or rules as necessary.
L.
No person shall use, enter or be in the facility outside
of its hours of operation, as posted on the facility or its structures. No
person shall use, enter or be in the facility after being notified by the
Village that they need to leave the facility by reason of the existence of
an unsafe condition.
M.
All forms of graffiti, tagging, or other means of defacing
Village property are strictly prohibited. Such activity will result in closure
of the facility until it can be cleaned/repaired.
N.
No person at or in the facility or on any structure shall
violate any rule or regulation contained in this chapter or otherwise adopted
and posted on signs at the facility or on any structure within the facility.
Hours for the months of April, May, September and October will be daily
from 12:00 noon to 7:00 p.m. Hours for the months of June, July and August
will be daily from 12:00 p.m. to 9:00 p.m. The Village of Groton reserves
the right to close the facility at any time for any reason.
Violation of any provision of this chapter shall be punishable as provided in Chapter I, General Provisions, Article III, Penalties for Offenses, or in the case of a person accused of damaging the facility, restitution for repair of damages and/or appropriate community service. Persons in violation of § 112-4 may be subject to having their pass revoked. Nothing contained herein shall be deemed to limit the right of the Village to pursue a claim for damages under the provisions of New York General Obligations Law § 3-112.
If any clause, sentence, paragraph, word, section or part of this chapter
shall be adjudged by any court of competent jurisdiction to be unconstitutional,
illegal or invalid, such judgment shall not affect, impair or invalidate the
remainder thereof, but shall be confined in its operation to the clause, sentence,
paragraph, word, section or part thereof directly involved in the controversy
in which said judgment shall have been rendered.
