[HISTORY: Adopted by the Board of Trustees

As used in this chapter, the following terms
shall have the meanings indicated:
Includes both combustible and noncombustible materials, such
as waste of meat, fish, fruits, vegetables or vegetable matter, including
tin cans that have contained food material; also paper, wood, leather,
cloth or any other combustible matter; also glass, metals, plastics
or other incombustible materials; and also ashes, soot and cinders.

A.
For the storage of garbage before collection, every
householder shall provide metal or other suitable receptacles with
overlapping and tight-fitting covers. Such receptacles shall be kept
securely covered in such a manner as to exclude dogs, rats and flies.
B.
Garbage cans must be kept in a clean and sanitary
condition.

The burning of garbage by the householder is
prohibited.
A.
No person shall dump garbage, rubbish or refuse within the Village
limits unless prior approval for such dumping is granted by resolution
of the Village Board. In granting or denying such permission, the
Village Board shall, without limitation, consider what materials are
supposed to be disposed of; whether the garbage, rubbish or refuse
is considered hazardous or nonhazardous waste or solid waste as defined
in federal or state laws, rules or regulations; whether the garbage,
rubbish or refuse proposed to be disposed of may result in environmental
impacts or impact human or animal health or safety; whether the proposed
disposal includes controlled substances under federal law or regulated
medical waste under federal or state law; whether the garbage, rubbish
or refuse proposed to be disposed of includes food waste or other
putrescible materials; the proposed location of such disposal; whether
the applicant has obtained the written permission of the owner of
the property where the disposal is to take place; and whether the
proposed disposal of garbage, rubbish or refuse is in compliance with
federal and state environmental or waste management laws, rules and/or
regulations.
B.
The Village Board shall, and hereby does, designate the Supervisor
of Public Works to have general supervision over the disposal of garbage,
rubbish or refuse within the Village. The Village Code Enforcement
Officer is expressly authorized to take actions to enforce the provisions
of this chapter.
C.
Any person who places personal household garbage, rubbish or refuse in a receptacle located in a public place in the Village and provided by the Village or any Village property owner or business owner shall be in violation of this chapter, and shall be subject to the further provisions with respect to enforcement (§ 119-10) and/or penalties for violations (§ 119-12).

No corporation, firm, association or individual
shall engage in the collection of garbage or ashes or refuse within
said Village of Groton without first obtaining from the Village Board
of said village a license to carry and dispose of garbage, ashes and
refuse. The fee for such license under this chapter shall be such
a sum as may be determined by the Village Board by resolution and
shall be payable at the time such license is issued.
Any person, firm, association or corporation
applying to the Village Board for a license to collect garbage, refuse
and ashes under this chapter shall make said application in writing,
stating the names and residences or places of business of said applicant
and also a description of the conveyance to be used for the collection
of said garbage, trash and ashes. Said conveyance must be approved
by the Village Board.
Any conveyance used in the collection and conveyance
of garbage in said village shall have thereon the name or names of
the owner or owners and the number of the village license.
A.
Any license granted under this chapter shall be granted
for a term to end on June 30 next following the granting thereof.
B.
Any license shall be subject to summary revocation
thereof by the Village Board for violation of this chapter.
C.
The Village Board, at its discretion, may require
the posting of a performance bond, in a sum to be determined by said
Board.
D.
The Village Board may restrict the license to a single
individual, firm or corporation, and, if there is more than one application
for said license, the Village Board shall decide to whom such license
shall be granted. The Village Board's decision shall be final.
A.
The equipment to be used by the collector or collectors
of garbage, trash and ashes shall be so constructed as to make impossible
the spilling of any ashes, refuse or garbage. In transporting such
garbage, refuse and ashes through the village, the trucks shall be
loaded in such a manner that none of the contents may spill upon the
streets or highways.

B.
The materials spilled during the process of loading
any garbage, refuse or ashes must be immediately cleaned up.[1]

The Supervisor of Public Works and another Village
employee designated by him shall be in full charge of all matters
concerning the dumping and placing of refuse, garbage or ashes. Failure
of the collector or collectors to obey the directions of the Supervisor
of Public Works or his representative shall be deemed a violation
of this chapter.[1]

The Supervisor of Public Works and the Village Code Enforcement
Officer shall have the power and authority to formulate, from time
to time, such additional rules, regulations and directions, consistent
with the provisions of this chapter, as they or either of them may
deem necessary for the proper conduct of the work and for maintaining
sanitary conditions within and about the Village. Any such rules,
regulations and directions shall not be enforceable until approved
by resolution of the Village Board.
