The Board of Trustees finds that it would be in the best interest of the Village of Kings Point if uncompensated elected officials of the Village, both active and retired, were permitted to participate in the same health- and dental-care plans made available by the Village, from time to time, to its full-time employees, provided that no part of the cost of such participation is borne by the Village. This would tend to attract competent residents to serve in such positions without any cost to the Village or its taxpayers. This Board further finds that the attractiveness of such plans would be extremely limited if the right to continued participation could be removed at the discretion of a future Board of this Village.
The Board of Trustees of the Village of Kings Point hereby extends to all unpaid elected officials and retired unpaid elected officials of the Village and their surviving spouses the right to participate in the health and dental insurance plans from time to time established by the Village for its full-time employees.
As used in this chapter, the following terms shall have the meanings indicated:
RETIRED UNPAID ELECTED OFFICIALS
Persons who retire from elective office in the Village on or after August 20, 1992, having served in one or more unpaid elective offices in the Village for a period of not less than five years. Said five years do not have to be consecutive and may include service rendered prior to August 20, 1992.
UNPAID ELECTED OFFICIALS
All unpaid persons holding elective office in the Village of Kings Point on or after August 20, 1992.
A. 
Unpaid elected officials and retired unpaid elected officials may participate in said plans on an individual or family-plan basis.
B. 
The surviving spouse and other dependent family members of deceased unpaid elected officials and retired unpaid elected officials may participate in said plans, provided that they qualify for dependent survivor coverage pursuant to the terms of the plan, so long as said terms do not distinguish between full-time employees and unpaid elected officials.
C. 
The full cost of participation in said plan shall be borne by those unpaid elected officials, retired unpaid elected officials, their surviving spouses and other dependent family members who elect to participate.
The benefits set forth in this chapter shall be deemed a contractual obligation of the Village to all unpaid elected officials, retired unpaid elected officials, surviving spouses and dependent family members who exercise their rights pursuant to this chapter. Any future rescission, modification or other amendment to this chapter shall not affect the contractual rights of those unpaid elected officials, retired unpaid elected officials, surviving spouses or dependent family members who are participating in the health-care plan at the time of such rescission, modification or other amendment.
