The purpose of this chapter shall be to preserve
the public peace and good order in the areas located within the Village
of Manlius and operated as public parks and to contribute to the safety
and enjoyment of the users of the parklands by regulating the hours
of use, and the use of motorized vehicles and by prohibiting certain
activities inimical to customary park recreation uses.
A.
The parks shall be opened and closed at the time and/or
hour designated by the Village Board. No person shall use the park
at a time and/or hour other than that designated by the Village Board,
and the use of the park at a time and/or hour other than that so designated
is hereby prohibited and is declared to be a violation of this chapter.
Opening and closing times shall be posted within the area of the park.
B.
The operation of any motorized vehicles such as automobiles,
motorcycles, minibikes, snowmobiles and the like is prohibited within
the area of parklands; provided, however, that the operation Of licensed
vehicles for the transporting of the public to and from the parklands
is permitted on all improved roadways, and the parking of such vehicles
is also permitted within designated parking areas.
C.
Hunting, trapping or the discharge of any firearm,
spring gun or air gun is prohibited within the area of any parklands.
D.
The sale or consumption of alcoholic beverages is
prohibited within the area of any parklands regulated pursuant to
the terms and conditions of this chapter unless such sale or consumption
is specifically permitted by other provisions of the Code of the Village
of Manlius.[1]
E.
No person shall take into, carry through, leave in,
throw, lay, drop or discharge into or on the parklands any tin cans,
bottles, refuse, garbage, rubbish or waste. No person shall throw
away or discard any match, cigar or cigarettes on or under any tree
or underbrush or grass unless it is to deposit same in a suitable
container provided for the reception thereof. Papers, cartons or any
other type of litter shall be placed in receptacles provided for that
purpose.
F.
No person shall injure, deface, displace, remove,
fill in, raise, destroy or tamper with any drive, path or walk; take
up, remove or carry away any trees, shrubs, turf or any material or
substance; or remove or destroy any structure, building or any appurtenances
connected with the park.
G.
No person shall utter loud and offensive or profane
or indecent language; do any obscene or indecent act; throw stones
or other missiles; annoy, obstruct, molest or interfere with any person,
path, walk or public place; loiter or create a disturbance while criminally
in possession of a controlled substance; introduce, carry or fire
any firecrackers, torpedoes or fireworks; or engage in, instigate,
aid or encourage a contention or fight.
A.
The parks of the Village shall be under the supervision
and control of the Village Board or such other person or committee
as the Village Board may designate from time to time.
B.
The Chief of Police of the Village is hereby empowered
and authorized to close any park for a period not exceeding 24 hours
whenever, in his opinion, such closing is necessary to preserve the
peace, safety and security of the park. Enforcement of this chapter
shall be by the Village of Manlius Police Department.
