In any area within the Town of Massena where, by zoning laws, it would
be permissible and proper for any party or person to conduct thereon circuses,
carnivals or similar forms of amusement or similar exhibitions or performances,
it shall be, from and after the effective date of this chapter, illegal and
unlawful for such circus or carnival as aforesaid to actually conduct operations
unless the party or persons sponsoring or responsible for said activity shall
have made application to and received from the Town Clerk of the Town of Massena
a permit, in writing, authorizing the activity, and further posted with said
Town Clerk the sum of $200 as a cash guaranty to the Town of Massena that
the area on which the activity is to be conducted will be satisfactorily cleaned
and cleared within a reasonable time after the completion of the activity
and to the satisfaction of the proper town authorities.

A.
Every applicant for a permit under this chapter shall
file with the Town Clerk a sworn written application, in duplicate, on a form
to be furnished by said Clerk, which shall give or be accompanied by the following:
(1)
Name and address of applicant.
(2)
Name and address of sponsor if different from the applicant.
(3)
Location of the proposed circus or carnival.
(4)
Duration of the activity and hours of operation.
(5)
Proof of insurance sufficient for the activity.
(6)
Such other information as the Clerk may require.
B.
No permit shall be issued by the Town Board unless and
until the applicant has demonstrated compliance with applicable local and
state health regulations.
C.
No permit shall be issued for a carnival at any location
less than two miles from the existing boundaries of the Village of Massena.

Any person committing an offense against any provision of this chapter
shall be guilty of a violation punishable by a fine not exceeding $250 or
by imprisonment for a term not exceeding 15 days, or by both such fine and
imprisonment. The continuation of an offense against the provisions of this
chapter shall constitute, for each day the offense is continued, a separate
and distinct offense hereunder.
