[HISTORY: Adopted by the Board of Trustees of the Village of Maybrook 4-23-1979 by L.L. No. 6-1979 as Article 10 of Chapter 52 of the 1979 Municipal Code; amended in its entirety 10-8-1979 by L.L. GENERAL REFERENCES
Vehicles and traffic — See Ch. 189.
The Village Court of Maybrook is hereby authorized to establish a Traffic Violation Bureau to assist the Court in the disposition of the offenses in relation to traffic violations set forth in § 47-2 of this chapter. The Court is further authorized to designate the person or persons to be in charge of such Bureau and to designate the hours which such Bureau shall be open.
The Traffic Violations Bureau is authorized to dispose of violations of traffic laws, rules and regulations, which such offenses shall not constitute the traffic infraction known as "speeding" or a misdemeanor or felony.

A. 
Appearance. Any person charged with an offense listed in § 47-2 of this chapter may answer at the Traffic Violations Bureau within a specified time, either in person or by written power of attorney in the form hereinafter prescribed, by paying a prescribed fine and, in writing, waiving a hearing in court, pleading guilty to the charge and authorizing the person in charge of the Bureau to make such a plea and pay such fine in court.
B. 
Full satisfaction by accepting fine. Acceptance of the prescribed fine and power of attorney by the Traffic Violations Bureau shall be deemed complete satisfaction for the violation, and the violator shall be given a receipt which so states.
C. 
Failure to appear within specified time. If a person charged with such a traffic violation does not answer, either as hereinbefore prescribed or by appearing before the Court within the time specified, the Traffic Violations Bureau shall cause a complaint to be entered against him forthwith and a warrant to be issued for his arrest and his appearance before the Court.
D. 
Persistent violators. Any person who has been, within the preceding 12 months, guilty of a number of parking violations in excess of such maximum as may be designated by the Court or of three or more violations other than parking violations shall not be permitted to appear and answer to a subsequent violation at the Traffic Violations Bureau, but must appear in court at a time specified by the Bureau.
E. 
Right to counsel. The Traffic Violations Bureau is not authorized to deprive a person of his right to counsel or to prevent him from exercising his right to appear in court to answer to, explain or defend any charge of a violation of any traffic law, rule or regulation.[1]

The Village Justice is hereby authorized to designate the fines to be paid for the offenses listed in Chapter 189, Vehicles and Traffic, which may be satisfied at the Traffic Violations Bureau in the manner hereinbefore stated, provided that such fines are within the limits established as penalties for such offenses, and is further authorized to designate the period or periods of time within which a person charged with such an offense may answer at the Bureau.
The Traffic Violations Bureau shall keep a record of all such violations of which each person has been guilty, whether guilt was established in court or in the Bureau, and also a record of all fines collected and the dispositions thereof. Such Bureau shall also perform such other or additional duties and keep such other or additional records as shall be prescribed by the Court.
The following is the written power of attorney to be used by persons answering charges by power of attorney in the manner hereinabove prescribed:
  I, the undersigned, hereby waive a hearing in court and plead guilty to the traffic violation of _______________________________ Summons # ______________, and duly constitute the person in charge of the Traffic Violations Bureau my attorney in fact, authorizing him to appear in court, enter my plea and pay my fine. This is my ____________ offense for this violation within the past 12 months.
