Whenever the Board of Township Commissioners shall require the construction, grading and paving of sidewalks or the setting of curbing, written notice of this chapter and its requirements shall be given by the Township Engineer to each and every property owner affected thereby.
If any property owner shall fail to commence performance of the work or fail to act in compliance with the requirements of this chapter within 45 days from the date of service of the notice provided for in § 250-7 hereof, the Township Engineer shall cause such work to be done; and if any property owner shall fail to complete the work required by the terms of this chapter within 60 days from the service of such notice, then and in such case the Township Engineer may cause such work to be completed, and in either case shall charge the cost of the work, together with a charge not to exceed 25% of the cost for general overhead and administrative expenses, against the owner of the property abutting the area where the work was performed. Should any such property owner fail to pay such charge within 60 days from the completion of the work, the claim shall be placed in the hands of the Township Solicitor for collection by action of assumpsit against said property owner or by filing a municipal lien thereof against the property as provided by law. The claim provided for in this section may be served on the property owner by leaving a notice at his place of residence or, if he has no residence in the Township, then by posting the same on the premises and mailing a copy thereof to the owner at his last known address.
