This article shall be known and may be cited
as the "Law Regulating the Parking of Vehicles on Town Streets and
Highways."

It is the purpose of this article to promote
the health, safety and general welfare of the inhabitants of the Town
of Shandaken by the proper regulation of the parking and abandonment
of vehicles on Town streets and highways, particularly during and
after snowstorms.

A.
It shall be unlawful and a violation of this chapter
for an owner or operator of any vehicle to park or permit his vehicle
to be parked or to abandon his vehicle on any Town street or highway
within the Town of Shandaken during a snowstorm or during the period
following a snowstorm until such street or highway has been plowed.
B.
No vehicle shall be left unattended on any Town street
or highway within the Town of Shandaken in such a manner as to constitute
an obstruction to traffic.
Any person violating any provision of § 111-3 shall be guilty of an offense and, upon conviction thereof, shall be punishable by a fine not exceeding $50 or by imprisonment for not more than 10 days, or by both such fine and imprisonment.
A.
When any vehicle is parked, abandoned or left unattended in violation of § 111-3, such vehicle may be removed and stored by or at the direction of the Town Superintendent of Highways, and he shall have authority to engage a private person or corporation to perform such removal and storage.
B.
After removal of any vehicle, as provided in the foregoing Subsection A, the Town Superintendent of Highways may store such vehicle or cause the same to be stored in a suitable place at the expense of the owner. Such owner or other person authorized by the owner may redeem said vehicle upon payment to the Town Superintendent of Highways of the amount of all expenses, not exceeding $25, necessarily incurred by him in effecting such removal, together with any charges for storage at the rate of not to exceed $3 per day or fraction thereof. Where such removal is performed by a person or corporation other than the Town Superintendent of Highways, payment therefor and for storage charges, if any, at rates not exceeding those set forth above, shall be made to the person or corporation having custody of the vehicle. The provisions of this section shall apply regardless of whether a conviction shall result from a violation of this article.

A.
When stopping is prohibited by this article or by
local law, ordinance, order, rule or regulation, no person shall stop,
stand or park a vehicle, whether occupied or not, except when necessary
to avoid conflict with other traffic or in compliance with the directions
of a police officer or a traffic-control sign or signal.
B.
When standing is prohibited by this article or by
local law, ordinance, order, rule or regulation, no person shall stand
or park a vehicle, whether occupied or not, but he may stop temporarily
for the purpose of and while actually engaged in receiving or discharging
passengers.
C.
When parking is prohibited by this article or by local
law, ordinance, order, rule or regulation, no person shall park a
vehicle, whether occupied or not, but he may stop or stand temporarily
for the purpose of and while actually engaged in loading or unloading
merchandise or passengers.
D.
When official signs have been posted prohibiting,
restricting or limiting the stopping, standing or parking of vehicles
on any highway, no person shall stop, stand or park any vehicle in
violation of the restrictions stated on such signs.
Upon any highway outside of a business or residence
district, no person shall stop, park or leave standing any vehicle,
whether attended or unattended, upon the paved or main traveled part
of the highway when it is practicable to stop, park or so leave such
vehicle off such part of said highway.
Except where angle parking is authorized, every
vehicle shall be stopped, standing or parked with the right-hand wheels
of such vehicle parallel to and within 12 inches of the right-hand
curb or edge of the roadway.
No person shall stand or park a vehicle, whether
occupied or not, except momentarily to pick up or discharge a passenger
or passengers:
A.
In front of a public or private driveway.
B.
Within 20 feet of a crosswalk at an intersection,
unless a different distance is indicated by official signs, markings
or parking meters.
C.
Within 20 feet of the driveway entrance to any fire
station and, when on the side of the street opposite to the entrance
of any fire station, within 75 feet of said entrance, when properly
sign-posted.
Stopping, standing or parking is prohibited
in the following places:
No person shall stop, stand or park a vehicle
within 15 feet of a fire hydrant, except when such vehicle is attended
by a licensed operator or chauffeur who is seated in the front seat
and who can immediately move such vehicle in case of emergency.
It shall be a violation for any person to stop,
stand or park a vehicle in any area designated as a place for handicapped
parking unless the vehicle bears a permit.
