The Town Board of the Town of Stony Point takes recognition of the fact that inquiries have been made with respect to the legality of permitting public exposure of persons at business establishments within the Town of Stony Point. The Town Board believes that such conduct is not acceptable in this community. Therefore, the Town Board of the Town of Stony Point enacts this chapter for the purpose of prohibiting, in any public place within the Town of Stony Point, public exposure of the private or intimate parts of the body of any person and promotion of such exposure as defined in §§ 245.01 and 245.02 of the Penal Law of the State of New York.
This chapter is enacted pursuant to the authority of Chapter 633 of the Laws of 1984 of the State of New York. It is further enacted pursuant to the authority of the Municipal Home Rule Law of the State of New York as well as pursuant to the authority of Article 245 of the Penal Law of the State of New York.
A. 
A person is guilty of exposure if he or she appears in a public place in such a manner that the private or intimate parts of his or her body are unclothed or exposed. For the purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola. This provision shall apply also to any person entertaining or performing in a play, exhibition, show or entertainment.
B. 
A person is guilty of promoting exposure of a person when he knowingly conducts, maintains, owns, manages or operates or furnishes any public premise or place where a person in such public place appears in such a manner that the private or intimate parts of his or her body are unclothed or exposed. For the purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola. This provision shall specifically apply also to any person entertaining or performing in a play, exhibition, show or entertainment.
A violation of § 163-3 of this chapter shall be deemed a Class A misdemeanor punishable by up to one year in jail and a fine of up to $1,000 per offense.
