A.
No person shall have in his or her possession or control
at any time any open bottle or open container containing alcoholic beverages
with the intent to consume the same within or upon any public place with the
exception that a person shall be allowed to consume such alcoholic beverages,
from cans and paper or soft plastic containers only, at the picnic tables
in the grassy picnic area of the Village Beachfront Park between the Village
Bathhouse and the New York State Canal between the hours of 7:00 a.m. and
9:00 p.m.
B.
For purposes of this section, "public place" is as defined
in § 240.00 of the Penal Law.
C.
For purposes of this section, "alcoholic beverages" means
and includes alcohol, spirits, liquor, wine, beer, hard cider and every liquid
containing alcohol, spirits, wine or beer and capable of being consumed by
a human being.
D.
The provisions of this section shall not apply to any
person who is upon premises covered by a license obtained by the owner or
lessee of the premises pursuant to the Alcohol Beverage Control Law and said
person consumes the alcoholic beverages on the premises in accordance with
such license.

No glass bottles or containers will be allowed on the grassy picnic
or beach areas.

A.
No open glass bottle or open glass container is permitted
in a public place as defined in § 240.00 of the Penal Law.
B.
No glass bottle or glass container of any nature is permitted
in or upon any picnic area, bathing beach or parking lot adjoining any bathing
beach within the Village of Sylvan Beach.
C.
The provisions of this section shall not apply to any
person who is in or upon premises privately owned and the owner or lessee
of said premises consents to such use therein.
A.
No person shall use offensive, disorderly, threatening,
abusive or insulting language or conduct or behave himself or herself in an
offensive, disorderly, threatening or insulting manner in or upon any public
sidewalk, street, highway, parking lot, bathing beach or other public place
or property or within or upon any vehicle while driving or standing in the
Village of Sylvan Beach.
B.
No person or persons shall act or conduct themselves
in such a manner as to annoy, disturb, interfere with, obstruct or be offensive
to others in or upon any public sidewalk, street, highway, parking lot, bathing
beach or other public place or property or within or upon any vehicle while
driving or standing in the Village of Sylvan Beach.
C.
No persons shall congregate in or upon any public sidewalk,
street, highway, parking lot, bathing beach or other public place or property
or within or upon any vehicle while driving or standing in the Village of
Sylvan Beach in such a manner as to annoy, disturb, interfere with, obstruct
or be offensive to others.
D.
No person or persons shall loiter, remain or wander about,
obstruct or otherwise interfere with the lawful passage of vehicular or pedestrian
traffic, engage in fighting or in any violent, tumultuous or threatening behavior,
make any unreasonable noise or noises, use abusive or obscene language or
make obscene gestures, congregate with other persons and refuse the lawful
order of the police to disperse or create a hazardous or physically offensive
condition by any action or actions which serve no legitimate purpose in or
upon any public sidewalk, street, highway, parking lot or bathing beach or
any other public place or property or within or upon any vehicle while driving
or standing in the Village of Sylvan Beach.

Any person violating any of the provisions of this chapter shall, upon
conviction thereof, be punishable by a fine not exceeding $250 for each offense
or by a maximum of 15 days' imprisonment in the county jail, or by both
such fine and imprisonment.

Village employees employed under the title(s) of Code Enforcement Officer, Assistant Code Enforcement Officer and Code Enforcement Officer Trainee are authorized to issue appearance tickets for violations of Chapter 85, Peace and Good Order.
