The following sections of the Charter of the City of Troy are hereby amended as indicated. New matter is underlined and deleted material is struck through.
A. 
Section C-21A(9) is amended to delete the reference to Section 3.08 as this section was (Reserved) and contained no provisions on powers of the Mayor. Said subsection shall read as follows:

To make all appropriations and, except as otherwise provided herein, all reappropriations of city funds, subject to the powers of the Mayor as enumerated in section 3.04 herein.
B. 
Section C-21A(10) is amended to delete the following language referring to Section 3.08 as this section was (Reserved) and contained no provisions on the veto power of the Mayor:

To adopt and to amend a capital budget, subject to the line item and general veto power of the Mayor.
C. 
Section C-23, the last sentence, is amended to revise the penalty from a maximum fine of $100 or imprisonment for not more than 30 days, or both, to a maximum fine of not more than $1,000 or imprisonment for not more than one year, or both, as follows:
Any person who fails or refuses to obey a lawful order issued in the exercise of these powers by the Council shall be guilty of a misdemeanor and punishable by a fine of not more than $1,000 or by imprisonment for not more than one year, or both.
D. 
Original Section 2.23.1, Codification, is repealed.
E. 
Section C-40 is amended to read as follows:
The City Council may provide in any penal ordinance that a violation of such ordinance shall be punishable as a misdemeanor by a fine not exceeding $1,000 or imprisonment for not more than one year, or both, or as violation by a fine not exceeding $250 or by imprisonment for a period not exceeding 15 days, or both.
F. 
Section C-76L is amended to read as follows:
There shall be a Division of Fire Prevention in the Bureau of Fire under the supervision and control of the Chief of Fire. This Division shall be responsible for the application and enforcement of the Fire Prevention Code of the City of Troy and all processes for permits, service orders , investigations, revocations, and inspections consistent with that part of the Uniform Fire Prevention and Building Code related to fire prevention.
