As used in this chapter, the following terms shall have the meanings
indicated:
Any vehicle or device nor limited to but including bicycles, rollerblades,
rollerskates, skateboard, scooters propelled by an operator or operators.

These regulations applicable to self-propelled devices shall apply whenever
a self-propelled device is operated upon any street or upon any public path
set aside for the exclusive use of self-propelled devices, subject to those
exceptions stated herein.
The parent of any child and the guardian of any ward shall not authorize
or knowingly permit any such child or ward to violate any of the provisions
of this chapter.

Every person riding a self-propelled device upon a roadway shall be
subject to the provisions of the vehicles and traffic laws of this Village
applicable to the driver of a motor vehicle,[1] except as to special regulations in this chapter and except as
to those provisions of such laws which by their nature can have no application.

A.
Any person operating a self-propelled device shall obey
the instructions of official traffic signals, signs and other control devices
applicable to vehicles and all regulations as set out in Article 34, §§ 1230
to 1236, inclusive, of the Vehicle and Traffic Law of the State of New York.
B.
Whenever authorized signs are erected indicating that
no right, left or U-turn is permitted, no person operating a self-propelled
device shall disobey the direction of any such sign, except where such person
dismounts from the self-propelled device to make any such turn, in which event
such person shall then obey the regulations applicable to pedestrians.
C.
Any person operating a self-propelled device on a Village
street, road, thoroughfare or in a Village park shall wear a protective helmet.
(1)
Passengers on bicycles or scooters under one year of
age prohibited; passengers and operators under 14 years of age to wear protective
headgear.
(2)
No person operating a bicycle shall allow a person who
is under one year of age to ride as a passenger on a bicycle nor shall such
person be carried in a pack fastened to the operator. A first violation of
the provisions of this subsection shall result in no fine. A second violation
shall result in a civil fine not to exceed $50.
(3)
No person operating a bicycle or other self-propelled
devices shall allow a person one or more years of age and less than five years
of age to ride as a passenger on a bicycle unless:
(a)
Such passenger is wearing a helmet meeting standards
established by the New York State Commissioner of Motor Vehicles. For the
purposes of this subsection, "wearing a helmet" means having a helmet of good
fit fastened securely upon the head with the helmet straps; and
(b)
Such passenger is placed in a separate seat attached
to the bicycle and such seat shall have adequate provision for retaining the
passenger in place and for protecting the passenger from the moving parts
of the bicycle.
D.
The operator and any passenger on any self-propelled
device shall wear a helmet which satisfies the standards adopted by the New
York State Commissioner of Motor Vehicles, or in the absence of the adoption
of such standards by the Commissioner, such helmet must satisfy the standards
recommended by the Snell Memorial Foundation, Safety Equipment Institute,
or United States Consumer Product Safety Commission.

No person shall park a self-propelled device upon a street other than
upon the roadway against the curb or upon the sidewalk in a rack to support
the self-propelled device or against a building or at the curb, in such manner
as to afford the least obstruction to pedestrian traffic and motor traffic.

No person shall ride a self-propelled device, as defined by this chapter,
upon any sidewalk within the Village of Warwick, New York.
It shall be an offense for any person to perform any act forbidden or
fail to perform any act required by this chapter.
Any person committing an offense against any provision of this chapter
shall be guilty of a violation punishable by a fine not exceeding $250 or
by imprisonment for a term not exceeding 15 days, or by both such fine and
imprisonment. The continuation of an offense against the provisions of this
chapter shall constitute, for each day the offense is continued, a separate
and distinct offense hereunder.
