[HISTORY: Adopted by the Board of Trustees of the Village of Warwick 4-16-2001 by L.L. No. 2-2001. Amendments noted where applicable.]
This chapter shall provide for expanded eligibility for appointment to Village committees, commissions and advisory boards or panels.
Residency requirements for appointment and continued service on standing Village committees, advisory boards and commissions shall not be limited to resident electors of the Village.
Preference shall be given to qualified Village electors, and where it shall be determined by the Village Board that the public interest would be served or where there shall be no qualified Village elector available for appointment, then and in such event the Village Board may in accordance with Village Law appoint a Town of Warwick resident, provided such person shall have one or more of the following qualifications:
A. 
Owner of a fee interest in real property located within the Village;
B. 
Own or be possessed of an interest in a business located within the Village;
C. 
Possess particular expertise or training which would advance the purposes of the particular board, commission or advisory panel;
D. 
Membership in or affiliation with the local Chamber of Commerce, civic organization or other recognized public agency with offices located within the Village.
Notwithstanding the foregoing, appointment or continued service of a nonresident shall be prohibited if such appointment or continued service will result in any board, committee or advisory panel having a membership with greater than 25% nonresidents.
A. 
Where as a result of change in the constitution of a board, committee or panel, the nonresident membership shall exceed 25%, then in that event, such board may continue to meet until such time as a vacancy then existing is filled, or where the 25% limitation is exceeded as a result of the change in residency or other qualification of a member, then in that event, the position by the least senior nonresident member of such committee, board or panel shall be declared vacant and shall be filled as a resident elector.
B. 
Any action taken by the Board shall not be invalidated by virtue of noncompliance with the terms of this chapter.
Notwithstanding the foregoing, membership and continued service on the Village Board, Zoning Board of Appeals and Planning Board shall be limited to resident electors.
Any prior inconsistent regulation shall be deemed superseded.
