The Kilbuck Township Volunteer Fire Company may nominate any of its members as special fire police, said nominations shall be made in writing and shall be submitted to the Secretary of the Board of Supervisors of the Township of Kilbuck.
Upon receipt of said nomination, the Board of Supervisors or its duly appointed representative shall conduct an investigation to determine the fitness of the nominee.
Upon receipt of a written report from its representative or by the Board of Supervisors, the names of the approved nominees shall be placed for appointment on the agenda of a regularly convened meeting of the Board of Supervisors of the Township of Kilbuck.
If the Board of Supervisors of the Township of Kilbuck is satisfied as to the fitness of a nominee, it shall, by resolution, appoint said nominee as a fire police person for a term to be determined by the Board of Supervisors of the Township of Kilbuck.
A fire police person cannot exercise any authority until said person has been confirmed by the Board of Supervisors of the Township of Kilbuck.
After confirmation the nominee must take an oath or affirm to support and defend the Constitution of the United States of America, the Constitution of the Commonwealth of Pennsylvania, the statutes of the Commonwealth of Pennsylvania, and the ordinances of the Township of Kilbuck.
A. 
The nominee shall be provided a badge of authority which the fire police person must display or display by wearing when exercising their authority.
B. 
The name of the Township of Kilbuck shall be shown upon said badge.
The fire police person shall have full police power to enforce the provisions of the Commonwealth of Pennsylvania Motor Vehicle Code[1] and the Commonwealth of Pennsylvania Crimes Code[2] that are within the scope of their limited employment or duties inasmuch as they are police officers in a limited capacity, and shall have the authority to:
A. 
Demand a vehicle operator show operator's license or vehicle registration.
B. 
Issue citations for summary offenses, both traffic and nontraffic.
C. 
Exercise such other police powers as may be necessary, under the circumstances, to facilitate and prevent interference with the work of fire persons in extinguishing fires.

The fire police person shall not have any authority other than as provided herein.
A. 
The fire police person shall exercise his or her duties without prior request from the Township of Kilbuck Board of Supervisors or the police officer in charge.
B. 
When performing his or her duties, however, the special fire police person shall be under the direction and control of the police officer in charge of the incident necessitating the fire police person to exercise the powers granted hereunder.
This chapter shall not be construed to grant the fire police persons the right and/or power to use firearms or other weapons in the exercise of their granted powers.
Whenever the Township of Kilbuck voluntary fire company is in attendance on a fire or when such special fire police person is on special duty, such special fire police person shall have the same power and authority in any other municipality as they would have had in the Township of Kilbuck.
If a member of the Pennsylvania State Police Department or the Sheriff of Allegheny County is in attendance rather than a member of the Kilbuck Township Police Department, the special fire police person shall be subject to the authority of the member of the Pennsylvania State Police or the Sheriff's Department of the County of Allegheny.
