[HISTORY: Adopted by the Borough Council of the Borough of Kutztown 4-19-2005 by Ord. No. 11-2005. Amendments noted where applicable.]
This chapter is adopted pursuant to the authority set forth in Section 1201(3) of the Borough Code of 1966 of the Commonwealth of Pennsylvania [53 P.S. § 46201(3)], as amended from time to time.
The Borough Council of the Borough of Kutztown does hereby adopt a seal in the form and image annexed hereto as Exhibit A[1] as the corporate seal of the Borough of Kutztown, effective as of 12:01 a.m., prevailing time, on the effective date. Any previously adopted or utilized corporate seal of the Borough of Kutztown shall be deemed abandoned and no longer approved as of such date and time.

The physical form of the corporate seal adopted pursuant to this chapter may take either or both of the following forms:
A. 
A metal die which can form an impressed, embossed or raised seal on documents; and
B. 
A stamp or other means of printing or applying such seal on documents and other objects utilizing ink.
The corporate seal adopted pursuant to this chapter shall be utilized for official purposes in accordance with the Borough Code of the Commonwealth of Pennsylvania and other applicable law, in such circumstances as the Borough Council may direct, and may be utilized in such circumstances as the Secretary of the Borough of Kutztown deems necessary or appropriate for proper corporate and governmental purposes. The corporate seal may be utilized in either the impressed or stamped form, or may be utilized for the purpose of affixing both an impressed and stamped or ink seal simultaneously, unless otherwise required by Section 1009 of the Borough Code of the Commonwealth of Pennsylvania or by any other legal requirement.
This chapter shall take effect on April 19, 2005.
