This municipality hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101 to 7210.1103, as amended from time to time, and its regulations.
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 to 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of this municipality.
Administration and enforcement of the code within this municipality shall be undertaken in any of the following ways as determined by the governing body of this municipality from time to time by resolution:
A. 
By the designation of an employee of the municipality to serve as the municipal code official to act on behalf of the municipality.
B. 
By the retention of one or more construction code officials or third-party agencies to act on behalf of the municipality.
In every instance where the Construction Code relies on provisions of other codes, such as the ICC Electrical Code, International Fuel Gas Code, International Mechanical Code, International Plumbing Code, International Private Sewage Disposal Code, International Property Maintenance Code, International Fire Code, or International Energy Conservation Code, the administrative provisions of those codes are not adopted by reference.
A. 
Section 103.2, Appointment, is changed to read as follows: "The building official shall be appointed by the Lower Frederick Township Board of Supervisors. The building official shall report to the Township Manager."
B. 
Section 103.3, Deputies, is amended to reflect that only the Township Supervisors have the authority to appoint a deputy building official.
A Board of Appeals shall be established by resolution of the governing body of this municipality in conformity with the requirements of the relevant provisions of the code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.

All relevant ordinances, regulations and policies of this municipality not governed by the code shall remain in full force and effect.
Fees assessable by the municipality for the administration and enforcement undertaken pursuant to this article and the code shall be established by the governing body by resolution from time to time.

A. 
Administrative. Modification of the Administrative Regulation:

Pursuant to and in accordance with State Act 92 Section 104(B), the Township will require permits for residential alterations and repairs pursuant to the International Residential Code of 2003, Chapter 1, Section 105, or any subsequent edition thereof.
2e.
Pursuant to and in accordance with State Act 92 Section 104(B), the Township will require zoning permits for all utility and miscellaneous use structures. Utility and miscellaneous use structures in excess of 100 square feet will require building permits.

Technical modifications of the International Fire Code of 2003:

Section F-505, Premises Identification, shall be added to as follows:
F-505.3 Identification of Truss Construction.
The owner of a building or structure containing truss construction in any form or manner shall maintain a truss emblem to the left of the main entrance and at a height of not less than five feet above grade. The truss emblem required under this section shall be purchased from the Township at a cost determined from time to time by resolution of the Township Board of Supervisors.
The owner and/or developer of a residential subdivision or residential condominium shall install and maintain a truss emblem within the public right-of-way or upon the common elements/area (in the case of a private street or condominium) at each entrance to such subdivision or condominium.
F-505.3.1 Purpose.
The purpose of this chapter is to install identification emblems on certain properties, buildings or structures containing truss construction for the protection of the health, safety and welfare of emergency responders.
F-505.3.2. Definitions.
(A)
As used in this chapter, the following terms have the meanings indicated, unless a different meaning clearly appears from the context:
(1)
Truss Construction. A combination of members, such as beams, bars and ties, usually arranged in triangular units to form a rigid framework for supporting loads over a span of structural members that connect together to span the space between the walls of the building to support a vertical load.
(2)
Truss Emblem. A sign consisting of an isosceles triangle not less than 12 inches horizontally by six inches vertically made of reflective material with white as the background and red lettering containing the following: “F” to signify a building or structure having a floor with truss construction; “R” to signify a building or structure having a roof with truss construction; or “FR” to signify a building or structure having both a floor and roof with truss construction.
F-505.3.3. Exemption.
Buildings existing at the time of passage of this ordinance shall be exempt from having a truss emblem until such time as renovation or addition shall require investigation and plans showing installation of roof or floor trusses.
F-505.3.4. Fire Marshal/Code Official/Building Inspector/Official Approval.
The owner and/or developer of any building or structure required to have a truss emblem under this section shall submit a plan for such truss emblem as to design and location for the prior review and approval of the Township Fire Marshal or Building Inspector.
F-506 Key Boxes.
Where access to or within a structure (commercial-institutional-industrial) or an area is restricted because of secured openings or where immediate access is necessary for life-saving or fire-fighting purposes, the fire code or building official is authorized to require a key box to be installed in an approved location. The key box shall be of an approved type and shall contain keys to gain necessary access as required by the fire code official. The owner or operator of the building shall immediately notify the fire or building code official and provide the new key when a lock is changed or rekeyed. The key to such lock shall be secured by a key box. Existing structures at time of passage of this ordinance not having a key box shall not be required to have same until such a time as any change is requested for such structure and with concurrence of the fire code or building official.
