No person shall place or store upon any lot or plot or in any store or structure not fireproof or fire-resistant in the village any Christmas trees, wreaths, holly or other Christmas greens for the purpose of sale or otherwise without first obtaining a permit therefor from the Village Clerk for the Christmas season of the year in which application is made.
Every application for a permit required in § 94-1 shall be made upon a blank furnished by the Village Clerk, shall be verified, shall contain the name, age and residence of the applicant and shall contain provisions that the applicant, in consideration of the issuance of the permit, agrees to hold the village harmless from all suits and damages claimed against the village because of the negligence of the applicant, his agents and employees. It shall also contain a statement that $200 is deposited with the village for the purpose set out in § 94-3.
A. 
Amounts. The applicant for a permit hereunder shall, upon application for a permit hereunder, deposit with the village the sum of $200 and shall, at the same time, pay a permit fee of $25.
B. 
Purpose of deposit. The deposit shall be given to assure and guarantee for the benefit of the village that the applicant will remove all merchandise and Christmas rubbish from said lot or plot where same is placed as aforesaid, and from the adjacent street, on or before December 29 of the permit year.
If the merchandise and Christmas rubbish is not removed on or before the 29th day of December of the permit year, as provided in § 94-3, then the village may remove same and charge the cost thereof against the deposit of $200.
If the removal provided for in § 94-3 is made by the permittee in compliance with this chapter, then upon presentation to the Village Clerk of a certificate signed by an officer of the Fire Prevention Bureau certifying due compliance with the provisions of this chapter, the deposit aforesaid shall be returned to the permittee.
No permit issued pursuant to this chapter shall be construed to relieve any permittee from the duty to properly store and maintain said merchandise in order not to endanger adjacent property or to interfere with the operations of the Fire Department or egress of occupants from said premises or adjacent premises in case of fire.
In no event shall any Christmas trees, wreaths, holly or other Christmas greens be stored or offered for sale on any plot within 20 feet of any building or structure in the village.
No Christmas trees, wreaths, holly or other Christmas greens shall be stored or placed upon any lot, building or structure where gasoline is stored or sold.
