There is hereby established a Department of Administration, the head of which shall be the Administrator.
A. 
The Administrator shall be nominated and, with the advice and consent of the Council, appointed by the Mayor pursuant to N.J.S.A. 40A:9-137.
B. 
The Administrator shall hold office at the pleasure of the Council, except that he may be removed at any time by a two-thirds vote of the Council. The resolution of removal shall become effective three months after its adoption by the Council. The Council may provide that the resolution shall have immediate effect; provided, however, that the Council shall cause to be paid to the Administrator any unpaid balance of his salary up to the date of the adoption of the resolution and his salary for the next three calendar months thereafter.
C. 
The Administrator may designate a borough employee to perform the duties of the Administrator during his absence or disability, provided that it is less than 30 days. If the Administrator shall fail to designate an Acting Administrator or should his absence or disability exceed 30 days, the Mayor, with the advice and consent of the Council, shall make such appointment.
D. 
On removal or resignation of the Administrator, the Mayor, with the advice and consent of the Council, may appoint an employee of the borough or any other person to serve as Acting Administrator for 90 days or until an Administrator is appointed pursuant to Subsection A above, whichever is sooner.
A. 
The Administrator shall be paid a salary as fixed and adopted by the Council in the annual Salary Resolution within the guidelines established in the borough's Salary Ordinance.

B. 
Unless otherwise provided, no Acting Administrator shall be paid more than his regular salary while serving in that capacity. If the Council, by resolution, increases the compensation of the Acting Administrator during his term of office, such increased compensation shall not exceed the salary set forth in the Salary Ordinance for the position of Administrator.
A. 
The Administrator shall be appointed on the basis of his executive and administrative qualifications. Previous experience in local government and possession of a degree in public administration or municipal management shall be preferred.
B. 
The Administrator need not be a resident of the borough at the time of his appointment and may reside outside the borough thereafter.
A. 
The Administrator shall be the chief administrative officer of the borough and shall have the following duties and responsibilities:
(1) 
To administer the business affairs of the borough.
(2) 
To generally assist the Mayor in performing his executive function.
(3) 
To assist the executive committees of the Council responsible for overseeing the various municipal departments, and to make such reports and recommendations as may be needed or requested by the Mayor and Council.
(4) 
To direct and supervise, to the extent authorized by law, the administration of all departments offices and agencies of the borough.
(5) 
To report and make recommendations to the Mayor and Council on personnel issues and policies; to hire, to the extent authorized by law, entry level employees after a position has been created and a salary range established by previous action of the Council; and to report at the next regular meeting of the Mayor and Council any action taken under the authority of this subsection.
(6) 
To coordinate the performance of all borough employees and act as liaison between the Mayor and Council and the Borough Attorney, Borough Engineer and Borough Auditor.
(7) 
To establish and maintain sound personnel practices and maintain appropriate records on all borough employees.
(8) 
To report and make recommendations to the Mayor and Council on available federal, state and county grant, loan and assistance programs which may be of interest to the borough.
(9) 
To report and make recommendations to the Mayor and Council on contractual services received, on materials, equipment and supplies purchased and on the award of bids based on the recommendations of the effected borough departments and any involved consultants.
(10) 
To attend all public meetings of the Mayor and Council and other meetings when so requested.
(11) 
To prepare and submit the proposed borough operating budget annually by obtaining appropriation requests from department heads by November 15 and reviewing such requests with the Mayor and Council; to transmit a tentative budget to the Mayor, and Council by December 15; and, after consulting with the Mayor and Council, to submit by January 15 his final recommendations in the form required by law for municipal budgets and appending thereto a detailed analysis of the various items of expenditure and revenue and such exempletory comment or statement as he may deem desirable.
(12) 
To prepare and submit the annual capital budget to be considered and adopted by the Mayor and Council.
(13) 
To monitor the operating and capital budgets after adoption and, with the assistance of the borough's Chief Financial Officer, report at least monthly during the year to the Mayor and Council on the status of all accounts.
(14) 
To ensure that all laws and all acts of the Council subject to enforcement by him or by officers and employees subject to his direction and supervision are faithfully executed.
(15) 
To provide the Mayor and Council with a verbal report on administrative activities of the borough at each regular Council meeting and submit such written reports as may be requested by the Mayor and Council.
(16) 
To keep the Mayor and Council fully advised as to the current and future needs of the borough and make such recommendations concerning the affairs of the borough as he deems advisable.
(17) 
To assist in negotiating contracts for the borough as authorized by and subject to the approval of the Mayor and Council.
(18) 
To receive and reply to all inquiries and complaints concerning the borough's business and provide information and assistance to resolve them.
(19) 
To investigate, examine or inquire into the affairs or operation of any department, division, bureau, office, board or agency of the municipal government unless prohibited by law.
(20) 
To perform such other duties as may be requested by the Mayor and Council and perform those duties set forth in the job description established for the Borough Administrator's position which may be modified from time to time by resolution of the Council.
B. 
Except for the purpose of inquiry, the Mayor and Council shall deal with the administrative staff only through the Administrator and shall not give orders or direction to any borough employee except through him.
A. 
The Administrator shall devote full time to the interests of the borough. The Mayor and Council reserve the right at any time to set specific hours for the Administrator by resolution.
B. 
The Administrator shall also perform the functions of the Borough Purchasing Agent.
C. 
If the Administrator is also appointed Chief Financial Officer, he shall be known as the "Borough Administrator/Chief Financial Officer."
D. 
The Administrator may also be appointed by the Council to serve as the Deputy Borough Clerk, fulfilling the responsibilities of the Borough Clerk during his/her absence.

A. 
Appointment; duties of Borough Clerk. The Council shall appoint a Borough Clerk. The Clerk shall:
(1) 
Serve as Clerk of the Council, keeping its minutes and records of its proceedings and maintaining and compiling its ordinances and resolutions as required by law.
(2) 
Serve as Registrar of Vital Statistics, including births, deaths, and marriages in accordance with state law, and issue marriage licenses pursuant to law.
(3) 
Have custody of the Borough Seal and affix it to such books, papers and documents as may be authorized pursuant to law.
(4) 
Have and take custody of all official books, papers and documents of the Borough for which no other repository is provided by law or ordinance and preserve and keep them safely.
(5) 
Perform such functions as are vested in the Borough Clerk by the licensing provisions of state law or ordinance.
(6) 
Perform all of the functions required of municipal clerks by the General Election Law, pursuant to Title 19 of the Revised Statutes.
B. 
Deputy Clerk. The Council may appoint a Deputy Clerk, which may be the Borough Administrator, to assume the functions of the Borough Clerk during his/her absence.

Appointment; compensation.
A. 
The Municipal Recycling Coordinator shall be nominated and, with the advice and consent of the Council, appointed by the Mayor.
B. 
The Municipal Recycling Coordinator shall be paid a salary as fixed and adopted by the Council in the annual salary resolution within the guidelines established in the Borough’s Salary Ordinance.[1]
