Borough of Netcong, NJ Article IV Municipal Prosecutor

§ 13-10 Position established.

There is hereby established the position of Municipal Prosecutor for the Municipal Court of the Borough of Netcong.

§ 13-11 Appointment; term of office.

A. The Municipal Prosecutor shall be nominated and, with the advice and consent of the Borough Council, appointed by the Mayor.

B. The Municipal Prosecutor shall serve for a term of one year from the date of appointment and until a successor is appointed and qualified.

§ 13-12 Qualifications.

The Municipal Prosecutor shall be qualified as an attorney at law of the State of New Jersey in good standing.

§ 13-13 Compensation.

The Municipal Prosecutor shall be paid a salary as fixed and adopted by the Borough Council in the annual salary resolution within the guidelines established in the borough's salary ordinance.

§ 13-14 Duties.

The Municipal Prosecutor shall represent the borough in matters tried in the Municipal Court involving violations of the ordinances of the borough and in matters where, in the discretion of the Municipal Court Judge, the services of a Municipal Prosecutor are required. The Municipal Prosecutor shall also appear in the Municipal Court on behalf of the borough in matters where his services are requested by the Chief of Police or the Borough Attorney. The Municipal Prosecutor shall also appear on behalf of the borough in any court of competent jurisdiction of this state where such appearance is required by the Rules Governing the Courts of the State of New Jersey.
