No person shall place material or vehicles or
other equipment upon any Borough street so as to interfere with the
flow of water along the gutters or to interfere with traffic on any
such street without having first obtained a permit from the Borough's
Zoning Official.
A.
Any person desiring a permit for street obstruction
shall make application therefor to the Zoning Official upon forms
provided for that purpose.

The application shall contain:

The application shall be accompanied by a cash deposit
or surety bond in an amount as shall be determined by the Borough
Engineer to guarantee the replacement of the street to its former
condition and the maintenance thereof for one year thereafter at the
cost of the applicant.
The permit shall state the approximate quantity
of material or the number of vehicles or equipment to be stored and
the time of such storage, and the same shall require that the material,
vehicles or equipment be adequately protected, safeguarded and lighted
at all times, in accordance with this article.

There shall be paid at the time of filing an
application for a street obstruction permit a fee of $75.
It shall be the duty of the permittee to properly
guard the materials, vehicles or other equipment so stored by erecting
suitable barriers, warning signs and lanterns. The permittee shall
be liable for any neglect to safeguard the traveling public.
The following acts are hereby prohibited:
A.
Damaging streets. The disturbing or tearing up of
any Borough street by the locking of wheels of any vehicle or attaching
a drag or other mechanism to the same or by any other means likely
to cause damage to the Borough street.
B.
Filling gutters. The filling of gutters along any
Borough street with dirt, fill, earth or other materials, irrespective
of the manner or distance by which the dirt, fill, earth or other
materials shall travel before reaching the Borough street.
C.
Obstructing drainage. The obstruction of drainage
to any Borough street by the spilling, filling, flowing or throwing
of stones, dirt, earth or other materials thereon.
D.
Water drainage on roadway. The diversion of surface
or other waters to and upon Borough streets, drains, gutters and culverts.
No person shall place any earth, dirt, stones, vehicles, equipment or other materials or articles upon any Borough street, or any part thereof, except in accordance with the provisions of this article. No person shall do or cause to be done any act, including the construction or buildings, grading, landscaping or otherwise, which shall cause or result in the accumulation of dirt, silt, earth or other materials upon the Borough street, storm drain, gutter or culvert. Any person violating any provision of this article which results in damage to or obstruction of any Borough street, gutter, storm drain or culvert shall be responsible for all expenses incurred by the Borough in repairing said damage or removing said obstruction, in addition to the penalty provided in § 247-20 of this article.
