A Municipal Court for the borough is established as of January 1, 1949. The Court shall be known under the name of the "Municipal Court of the Borough of New Providence."
The Municipal Court and Judge shall have the jurisdiction, functions, powers and duties provided by statute.
A. 
The Court shall have a Judge who shall be known as the "Municipal Judge." He shall have the qualifications set forth in N.J.S.A. 2A:8-7.[1] He shall serve for a term of three years from the date of his appointment and until his successor is appointed and has qualified. The Judge shall be appointed by the Mayor with the advice and consent of the Council.

B. 
The salary of the Judge shall be fixed by ordinance.[2]

The office of Clerk of the Municipal Court is hereby established. The Clerk shall be appointed by the Mayor with the advise and consent of the Council, with salary compensation set by ordinance.[1] The Clerk need not be a resident of the borough.

Any person applying for representation by the Municipal Public Defender shall, at the time of making such application, pay to the Municipal Court Administrator an application fee of $50. The Municipal Court may waive this fee in whole or in part if the Court determines that the application fee represents an unreasonable burden on the person seeking such representation. All such fees shall be paid over to the Borough of New Providence, and, until paid, the amount of such application fee established by the Court shall be considered a cost of assignment of counsel and subject to the provisions of this chapter.

A. 
The Municipal Prosecutor shall be appointed by the Borough Council. The Municipal Prosecutor shall serve for a term of one year from the date of his appointment and until his successor is appointed and qualified. The appointment shall be made at the annual reorganization meeting in January of each year. If a vacancy occurs during the course of the year, any appointment shall be for the balance of the unexpired year.
B. 
The Municipal Prosecutor, pursuant to N.J.S.A. 2B:12-27, shall be under the supervision of the Attorney General of the State of New Jersey or the County Prosecutor and may represent the state, county or borough in any matter within the jurisdiction of the Central Municipal Court or any other municipal court.
C. 
The salary of the Municipal Prosecutor shall be fixed by ordinance.[1]

A. 
Any person applying for representation by the Borough Public Defender or an assigned attorney shall pay to the Borough Municipal Court an application fee of not more than $200. The Municipal Court may waive the application fee, in whole or in part, if the Court determines, in its discretion, that the application fee represents an unreasonable burden on the person seeking representation.
B. 
The application fees so paid shall be deposited by the Municipal Court and turned over to the Borough Treasurer on a monthly basis.
