The Chief of Police may suspend without pay any officer in the Department for any period not exceeding five days pending the filing of formal charges on account of inefficiency, incompetency, misconduct, negligence, insubordination or other sufficient cause afforded by law.
Temporary emergency suspensions may be ordered by the officer in charge or any other superior officer whenever the conduct or action of a subordinate officer of the Department is deemed necessary. All such suspensions shall be reported immediately, in writing, to the Chief of Police for his approval.

All suspensions will be reported by the Chief of Police by the governing body, which shall confirm the suspension or order the suspension set aside or modify or direct such other disciplinary action as required according to the gravity of the alleged defense(s) or violations. The officer so charged shall be entitled to a hearing. Such suspensions and/or requests for more disciplinary action will be guided by the department of personnel regulations.
A. 
No police officer of the Police Department shall be suspended as punishment, fined, reduced in rank or removed from office, except for the reasons allowed by law and in accordance with the procedures prescribed by the Department of Personnel.
B. 
Any officer so suspended, fined or demoted shall have the same right of appeal to the Department of Personnel as provided in the case of removals.
